Did you visit the consulate today? What did they say?

A couple of ideas which may help...

(1) You may want to call the Polish embassy and talk to the consular affairs section. Explain the situation, and ask if they can contact the french embassy to clarify what the problem is with a Polish ID card.

(2) Call the french embassy. (Stay very very calm as yelling at them will not get you anything). Explain the situation again and ask them how you can quickly resolve the situation. If they still say it is not valid, ask to speak to a manager in the visa section, and give them the contact name in the polish embassy.

(3) Submit an application by post and send in the ID card. Explain in writing you are including a valid national ID card as recognized in Directive 2004/38/EC, that you are applying for a visa for your wife. You might want to include language like
This application is for a short-stay multiple entry Schengen visa for the wife of an EU citizen. As such, I understand that no fee is applicable, and that this application will be considered on the basis of an accelerated procedure as per Directive 2004/38/EC.
Point (3) is important, because then they are forced to put the rejection in writing, which is essential if you want to sue them.

I am curious how this evolves. Please keep us informed!

I would be especially interested if the Polish embassy is responsive to helping you. I would hope they might be quite useful.

Great Work!

Good Luck!

Let us know how it goes - I am getting frustrated with embassies and visas to the point that I will be following your example shortly.

Sorry to butt in... I agree that the French embassy acted innapropriately, but would you not save yourself a bit of hassle by producing your passport?

Rogerio you TOTALLY mis the point! The French embassy has to act according to the law in order to make it easy for the union citizen by accepting a national ID. The rest of europe is not britain... in other words they have the option to travel on national ID's so many dont bother applying for passports!

Anecdotally, the French and quite a few other member states don't have any problem ignoring "union law" when it suits them. It's one of the reasons why membership of the European Union is a less-than-happy experience for some of the member states that do tend to implement what they have signed up to do.

Sorry to have missed the point - Personally I normally go for the easier option. Good luck.

johnsienk wrote: Since I no longer need a passport, I didn't renew it after the accession to the EU. My brother traveled all the continent on his ID, my mum comes to the UK twice a year on IT. I send my ID to the Home Office to apply for my wife's visa (residence as a spouse of EU citizen) and used it on many other occasions with no problems.
To get a passport, I'd have to take a day off and go to London (as I don't live in London) to get to the Polish embassy, pay money and then wait 3-4 months for a document that I, in fact, do not need, as I am not planning on leaving the continent anytime soon. And the ID is easier to carry. Why should I go into all this hassle just to satisfy the French, if they clearly are not right. It's good to know, however, that so far at least, the few EU bodies I complained to are taking it seriously. We will see what the outcome of the investigation will be.
You never know when you might need to travel urgently outside Europe.

It would be far better to get a passport at your leisure now rather than perhaps miss a trip later on because of a delay.

Great work! Your posts bring a huge smile to my face!

I am using SOLVIT to see if i can force the Irish Govenment to more accurately follow EU directives. I also considering using the same agency to chase up on this crazy 'in person' application for Schengan visas. The more people who hammer away at these problems, the quicker the systems will be straightforward and simple to use.

Well done!

It is a pleasure to see a nicely written apology for something which was so clearly against rules.

Thank you for following through with the whole process to get it to this point!
