PSW to T-4 Visa App Query

One of my friend has the following queries, will highly appreciate any reply quoting any immigration rule.

2003 Jan: Enter int to UK as Student

2007: Extended as Student Visa

2009 June: Extend as Student T-4

2011 Jan: Jump to PSW

PSW Expiring on DEC 2012.

Question: Will he able to extend his Visa again as T-4. He has been told by several sources that he will not able to do that as he spent such and such time as student already. Is it true? If yes, do you have the link of Immigration act regarding this.

What course does he want to study? How much time has he spent studying at degree level with a tier 4 or student visa?

1 and half year as T4 on Degree Level and now want to extend for Masters.

What did he do for the other 6 years? What degree level course did he study to get his psw visa?

He started in college and finish up with BSc from a reputed Uni before switching to PSW.

Easy option is to go straight for ILR as you can apply 1 month before your 10 yrs (ie 9 yrs 11 month) since your friend came to uk in Jan 2003 and has visa till Dec (Assuming end of DEC) he should apply for his ILR under 10 year Rule.

how do you know he meets the rules for this category?

quite different from your first answer of 1 and half years!

It sounds like he may fall foul of the new 5 year limit on degree level study, unless he falls under one of the exceptions. See 245ZX(ha)

Well just assuming that he is having continuous period of stay as stated by OP. Of course he would need to meet all the rules under 10 year rule,I was suggesting in case he hasn't looked into that option.

It is fairly difficult to advise unless the OP states exactly what they have studied and the period of study whether they are falling foul of the new immigration rule of maximum period of study under below graduate and postgraduate level.

He can apply for ilr in dec remember u can apply 28 days before ...my dear, he is good to go ...
