applying one day before your leave expire

Post by ILR1980 » Fri Jul 20, 2012 9:30 pm

My friend visa was going to expire on 22 July which is sunday. He posted his application on Friday 20 by special delivery but because sat and sun is not working day .ukba will receive his application on 23 may one day after his leave expired Is there any issue here? As far I know if you use postal services then date of application is date of posting not date of recieving by home office. Am I right or wrong ? Thanks guys

I thought special delivery is treated as courier - as such the date of receipt by UKBA will be considered as the date of application? Is that not right?

No, the Royal Mail special delivery service is not the same as a courier service. So it is the date that the application was posted that is considered here.

I had sent my dependants postal application on a Friday(expiring on Sunday) by special delivery; reached UKBA on Monday morning. Have got Biometrics letters. So no need to be concerned.

that is exactly what I did and it was ok.

As a bonus waiting until the last day meant that when I got my BRP it was dated from the date they processed the application effectivly giving me and extra three months!
