This is a quick summary of our court date.

We went in and our solicitor called my wife first and the home office grilled her with questions about our relationship like:

1) how long we have been together
2) describe our house
3) how often do we get guests
4) what we did last night
5) what we did last weekend
6) what we got each other for xmas ( we couldn't remember lol )
7) how often we see her family


and loads more, very hard for a fake couple to answer these questions to be honest, we had some discrepancies in our answers but they were perfectly acceptable as our solicitor said if we memorised our answers it would have looked dodgy.

Then they asked me the same questions, and we had loads of witnesses including my sister in law. The judge then asked her if she came specifically for the court and she said yes.

The judge then asked me to see the video of the wedding to prove that we did not need an interpreter (She had already seen loads of pics and statements)

At the end of the case she asked the home office lawyer if she has anything else to add.

The home office lawyer said that we could be really good friends and there were discrepancies with our answers for xmas presents to each other ( its bloody august! )

and

how we spent last weekend- my wife said things that we did and I said other things, we actually did both but I guess each of us had a different prospective of what we did


She also added that the registrar who is a government official who sent the letter had no reason to fabricate the evidence even though it was clearly proved that they did

She then implored the judge to dismiss the appeal.
This was the judges reply word for word

"I hear what your saying miss Johnson but due to the overwhelming evidence I am under no doubt that Mr **** and Mrs **** are a genuine couple. Because of this I will be allowing this appeal." The judge then looked at us and said " you will be receiving confirmation in writing in 10 working days."

And that's it, hopefully I get the decision before Mid August, so that I can reply to the email from the home office saying if I pass they will deal with our case ASAP.

I might make my next holiday in September :)

I think it´s more expensive, but with this I am sure that might send secure avoiding delays (I have read the forum a lot and I know the risk about that).

This is my advice to the new EEA application senders.

Send email to EuropeanOperational@homeoffice.gsi.gov.uk to log a formal complaint. They replied and said they forwarded it to the European Casework department.

Does anyone know how many days it takes for EEA2 applicants details to be input in the UKBA system? I called today and after checking i was made to understand my details re not yet in the system. Is it normal or ???

My application was received on 19.06 .. called them today, they told me they still didnt check my case, but they have received it (news news)

so yeah .. the waiting game continues !!

Well, well, well....

Less than 48 hours after being told no decision had yet been reached on my wife's February 4 application and me sending the Home Office an email threatening legal action in the small claims court, the RC arrived today.

The RC is simply an endorsement in her passport rather than a separate document but it will serve its purpose!

All our documents appear to have been returned, including her old Spanish RC which I was concerned they would hold onto; it serves as her Schengen visa so means we don't have to pfaff around with European embassies and consulates until 2014.

Her timeline:

EEA2 sent 06 February 2012
HO received 07 Feb 2012
COA received 14 March 2012
Home Office in breach of EU Laws: 06 August 2012
RC issue date: 11 August 2012
RC received: 16 August 2012

Our original application dated mid-December was rejected in mid-January due to insufficient paperwork.

Good luck to everyone else who is waiting on this shambles of an authority and fire off strongly-worded emails threatening legal action as soon as the six-month EU deadline passes as it seems to be the only language they understand!

You won't need a Schengen visa to enter the Schengen zone with a EEA2 RC (provided your spouse travels with you or joins you in that country) - so no need to faff around with embassies in any case!

Received by HO on 31 July
Passport requested back on 31 July
Received passport on 8 Aug!

So just request it. I mentioned in my request that I needed it to go to a family wedding and that I wanted to ensure that the application can proceed after they have verified and sent back the passport.

I've sent my documents to request the RC on the 24th of May, with delivery confirmation on the next day.so far I still haven't received the coa.
I called them today to chase it, as I want to apply for a new job and I have to prove them I'm a lawful resident in this country.
The person I spoke to said that she request a coa for me and I'm probably going to get it within 10 days..

Did some of you call them to chase the letter? And how it took for you to receive it?
