Hi I have applied for Tier 1 PSW on a professional qualifcation which is most likely to be refused.

I intend to apply as Tier 2.........my query is
Does a job has to be at a certain NQF level as the job that I am offered is a Software Test engineer which is below NQF 3 (I have an extensive IT qualification before embarking on ACCA).

My salary will be £21,000 and because I am switching from a PBS I do not require to meet RLMT. I will have a UK BSc degree next month which would also cover the English language requirement. Is there anything I am missing out???

My employer isn't sure about this neither am I ?

Have you applied for tier 2?

I am in same situation. My psw refused and i got right to appeal after i did appeal but unfortunately my appeal was dismissed by upper tribunal. After my appeal refused i apply for fresh application into tier 2 general. I got my master degree. I am waiting for reply from ukba.
I am confused about labour market test. My student visa expired on 30 july 2012.
My employer have to do labour market test or not?

In order to switch from tier 4 to tier 2 you have to have current leave under tier 4.

RLMT is required as your visa has expired, and I am assuming that 3C no longer applies to you as all of your appeals have been exhausted etc... This should have been conducted before your employer allocated your CoS.

Your job must be above NQF 6 based on codes of practice. Additionally, you need to be paid either above £20,000 OR the salary stipulated by your SoC code, whichever is higher. Otherwise, your visa will be refused outright.

RLMT or not, the application will be refused because you do not have current tier 4 leave.
