BOC=British national?

Post by nangvil » Sun Jan 28, 2007 11:46 am

I have a British Overseas Citizens Passport. Recently, a friend has asked me this question but I wasn't too sure bout the answer.

Am I considered a British/UK National?

I know I'm definitely not a British Citizen for sure.

The term "British national" is not legally defined but is a generic term to cover all categories of British nationality.

It doesn't mean you have a right of abode in the UK, however.

Have you got any other nationality?

I do yes, am currently on HSMP status.

I am about to apply for a new job(preference given to UK/EU)as well. On the application form, there's a similar question which states: Are you a UK national.

So, wasn't sure as well whether to state yes.

Obviously, if it said: Are u a UK citizen, I would have definitely stated no.

I very much doubt the people designing the application form know all the intricacies of British nationality law.

They may just be asking the question have you got work rights in the UK. Perhaps others on HSMP can say more on how they handle nationality related questions.

Is it for a government/public sector job?

You should then check if Civil Service nationality restrictions apply. If they do, then there is a specific definition of "UK national".

If not, they may just be saying they won't sponsor for a work permit OR they want someone with effective permanent residence in the UK.
