Latest on Zambrano Application

Post by Omonilollyjoor » Thu Nov 22, 2012 10:03 am

Hi everyone, I made an application on zambrano in January 2012, got my COA and another one reissued in AUgust 2012. after the announcement of the EEA regulations amendment which takes effect on 8th November, 2012. I got a letter from the UKBA dated 15th, in which an application form for derivative residence card was enclosed for me to fill and return, they also request for documents which I have already sent to them, I would like to know if anyone here has been contacted as well. Thanks for your patience and time.

Interesting if they have developed an application form that now includes Zambrano cases, as it's not yet up on the website!

Any chance you could scan a copy (redacting any personal information) and link to it for us? (unless it's just version 07/12).

It is funny with questionable legality that they could reject an application as invalid, return it and request another application to be filled, when that application has not even been published yet. As of yesterday the advice that Zambrano applicant use EEA2 seems to be in place.

Can you post a copy of the application for the benefit of forum members, as this will help them immensley. It would have been more helpful if UKBA had published the application , rather than wasting postage and time in sending application, for no fault of the applicant.

i was sent the form yesterday as well i filled it immediately and posted it today with a note em phasing that they have all the documents they are asking for and would be expecting my passport soon . its form DRF1 ( DERIVATIVE RESIDENCE CARD}. i think the form is just for the purpose of documentation emphasing we are applying for DRC that wouldn't lead to PR unlike the EEA2 form we previously filled that's my impression.

Hi all, I also received fresh application forms that is tailored to include Carer of a British citizen. It's a Form DRF1. Titled:APPLICATION FOR A DERIVATIVE RESIDENCE CARD, which is obviously not on their website yet. Also included was a CoA indicating that a decision will be reached within 6 months. What i do not get is if the application process has only just started. After waiting for a year! I thought a decision had been reached when my solicitor called me!

You are right, I think another CoA was issued because mine had expired. Hope they make decisions on old applications quicker.

Thanks everyone for your comment and post, I did not received another COA, just a covering letter emphasising on the section 3 to be filled. I sent mine back with a letter reminding them that they have my document with them. Good luck everyone

I would implore anyone who receive this application DRF 1 form to kindly scan it an forward it to the forum, to assist other members, and reduce their postage cost, and the further delay and hardship the UKBA is seeking to impose on them, by firstly, taking nearly 2, 8 and 10 years respectively, to enact legislation to give effect to Zambrano, Chen and Baumbast ruling, and for failing to publish this so called DRF 1, so as to reduce postal cost, and undue delays in dealing with applications that have been outstanding for over a year in violation of EU law.

I received the form on 19/11/12 and my solicitor will post it back before the 6/12/12. We were asked to send it back within 21 days. I've been to my solicitors office on Monday to complete the form, we are now waiting for my wife's medical report before we can send it back. Good luck all.

My COA will expire on 12 December and my solicitor wrote to them on 8/11/12 to deal with my application without further delay or issue me a new COA if they can't deal with my application before the COA expires on 12 December.
