Please reply: PSW Visa Rejected [Result got after 06 April]

Hi all,

My psw has been rejected on 28 Sept with the ground:
- my UOW result out on 26 Jul which pass the deadline of application, and
- due to the first section not manage to get 75 points, my english proficiency also being considered fail.

They did not given me appeal of right because I had visa on the date of visa rejection. So I am applying in High court.

I am in UK for 8yr and 4 months and my current student visa finishing in 8 days on 30th Nov, 2012. My question are ;

1. Can I stay in UK while my appeal is in High court ?
2. What are the chances in my case of my appeal?Any recent Outcomes?
3. How can I stay more about 1 year and 8 month to reach AT 10-Year Long residence ?
