No earnings for one year

Hi,

This is my post though I have been browsing this site for long and very thanks to all who have answered my questions when all have to do is search for them.

I complete my 5 years in UK in March 2012 which is when my Tier 1 visa expires. I have a question with regards to P60's. I have P 60's for 2009 - 2010. 2010 - 2011, 2011 - 2012 but do not have a P60 for 2008 - 2009 as I was not working and was looking for work.

Will not working for 1 year be a problem for applying for ILR.

Did you bother to read the requirements for ILR before posting this question? The information on the UKBA site is very clear.

You need to score points to qualify for ILR. The points will be calculated on the basis of your income in a continuous 12 month period taken from the 15 months immediately before the date of the application. Your 12 month period can begin in Jan, Feb or March 2012.

Collecting ancient paperwork that is not related to the points-based nature of your application is completely unnecessary.

First off, did you mean March 2013?
Second, as a tier 1 migrant you don't need to show 5 years P60s. All you want is to claim points for up to 12 months earning within 15 months prior to your application for ILR.
In your case, If you haven't earned anything for last 12 months and don't think you'd be able to earn enough to claim points required then you're pretty much looking on a dead end I'm afraid.

Apologies my earlier post says March 2012 instead of March 2013.

I do have sufficient funds in the last 12 months period to support my ILR application for March 2013. And the link by Lucapooka mentions of no documents like P60.

However, the only reason I was trying to gather documentation from my first year in the UK is because most of the people in this forum has supplied them as documentation for their ILR and some of the posts do say that the case workers have asked for them during their interview.

I was wondering whether any one has faced any kind of issues for their ILR with circumstances like mine.

supposedly they could say you breached the terms of your earlier visa by not being in employment. so you should try and show some form of economic activity in that period if possible.

Being employed for last 5 years is only relevant for WP holders since they are issued visa on the basis of an employer/work.
There is no such requirement for Tier 1 General holder. As long as you can claim required points for earnings in last 12 out of 15 months you're good to go.
Don't need to show 5 years P60 either.

Looking for work isn't "breaching the terms of a visa". There is no requirement for Tier 1 (General) visa holders to be employed full-time.
