OCI Doubt

Post by Aug07 » Fri Aug 24, 2012 4:37 pm

My child got british passport , but we both have Indian passport.
So is there any rule that my child can't apply for the OCI?

To apply OCI for my child either of the parent should have the British passport?

That is correct. Child can apply for PIO.

The condition is that the child cannot apply for OCI unless applying together with adult.

No, one parent has to have non-Indian citizenship ie be eligible for OCI.

It is obvious that one can only apply/eligible for OCI once he/she has non-Indian citizenship. The Question here is how the child having non-Indian citizenship can apply for OCI? and answer is only when accompanied with the parent who is applying for OCI and child application cannot be made on it's own.

OCI Doubt

How about father having British citizenship (and OCI) already and mother (Indian citizen) having ILR, now they have a new born son who has acquired British citizenship and going to apply OCI. Your statement is incorrect that child can apply OCI only when accompanied with the parent who is applying for OCI and child application cannot be made on it's own.

The statement was in the context of OP's question where both parents are Indian citizen. the child in this case cannot apply for OCI unless accompanied by adult applying for OCI.

The child can apply for OCI as an adult on her/his own merit and that should be sucessful

Do not know what you mean by that. it is clearly written on the OCI FAQ that child cannot apply on his own unless his/her application is accompanied by adult application for OCI.

@Manyaonisland, It did cross my mind. But, then I thought that maybe OP is saying that once the child becomes an 'Adult', he should be able to apply then. Maybe, OP can clarify?
