Today we received our documents back... with refusal after almost 9 months wait :(( Despite applying in April 2012, new rules of December were applied and my trips of business nature were not found of "compassionate nature"! No right of appeal. Happy New Year and Merry Christmas - UKBA style :(((

@Galathea,

Sorry to hear that, is your leave still valid?

How many days were you out of the country?

@Galathea,

around 200 days in one year for various business trips supported by my employer letter - was still a UK employed and tax payer. Our leave is valid till June.

The irony is that if I knew that it will take 9 months I would not apply now and wait for one more year as I didn't travel that much is subsequent years- would have saved a fortune with solicitors and fees and couple of ruined vacations. Now will need to extend my Tier 1 in June, pay again, and by the end of the year pay again and reapply for ILR....

Ah, i can feel the pain, I went through same.

Be patience, ask your solicitor to write them a refusal reconsideration letter that you fall in old rules.

It may help.

Thank you for the support. Back to reality now, compared to highly bureaucratic society I left in my home country I thought things are different here but no luck - all the same. Between my husband and myself we have 4 masters degrees and several fellowships, we speak 8 languages and paid thousands in taxes to this country - all in vain against all mighty bureaucracy...

ILR Refusal

Post by Spidery_thread » Fri Dec 28, 2012 10:25 am

You are absolutely correct, there are no exceptions by these civil servants sitting in the home office, for some ones brilliant talent, ties and time spent in the UK.

All they care is about their salaries and bonuses.

People are responsible for a failure of an institution, and I strongly believe that former chief executive UKBA, Lin Homer is responsible for her total incompetence and mismanagement and to bring in new tougher rules only for people with talent and great deal of experience to offer to this country.

Instead she was paid over a million pounds in salary plus approx 21000 bonus to lie and deceive.

Just to keep us away to merge into the society.

ILR at last

Post by ILR_finally » Wed Jan 02, 2013 7:12 pm

Hi guys,

I v been waiting to get this account set up for some days now so that I can share my time line. Finally we got there in the end.

Type of application: SET(O) + 2 dependants
Type of previous residency: 2 years HSMP + 3 years Tier1
Date Applied: 11/06/2012
Type of payment: Debit Card
Date they took the money: 14/06/2012
Date of the acknowledgement letter: 14/06/2012 received 20/06/2012
Date of biometric letter: 14/08/2012, received 20/08/2012, done on 23/08/2012
Date of approval: 19/12/2012
documents and passports and BRP returned 24/12/2012 with approval letter for ILR

Some Notes:

1) I did involve my MP early, just after my biometric n I think this really helped.
2) I got a job offer during my application, new employer used the checking services and a letter was sent to myself and the employer confirming ILR application n eligibility to work in the UK.
3) I actually changed job with this letter.
4) For me, I think if a decision can be made same day for face to face appointment, why will it take several months to make the same decision for a postal application?
5) The level of services from the UKBA are very poor n I think at the moment one of the ways to registered ur frustration is going thr ur MP. The MPs have access to UKBA thr parliamentary unit and any request is communicated through emails so, UKBA has within 2weeks to reply.
6) My advise get ur MP in as soon as u had ur biometric, find one or two excuses, waiting is a really frustrated thing to go through coupled with extremely poor customer services from UKBA.
7) Finally, please bombard them with calls (at least 3 times a day if u can) once your application reaches 6months mark. Every call u make is registered and this will trigger a force able response once it reaches a certain level and of course put pressure through ur MP as well, if u don't get any response from ur MP then ur ILR approval is just round the corner.

I hope this helps. I want to thank everyone that ve submitted their experiences through this medium, your info is very much appreciated. And if you are a silent reader, please share your experience, this might go a very long way to help others.

Thanks

We haven't heard anything from UKBA itself, but I did post some questions under Freedom of Information, and got the following responses today:

1. How many applications were received in the week commencing 24 September 2012?

There were 740 SET (M) postal applications received in the week commencing 24 September 2012.

2. Of these applications how many have not yet been processed?

Of the 740 applications received, 633 remain pending a decision.

3. If an application is made in the week commencing 24 September 2012, based on your current processing time when can the applicant expect to hear from UKBA with a decision?

The average processing time for decided SET (M) postal applications received in the week commencing 24 September 2012 was 28 calendar days

28 days? That sounds like a bit of a joke! I don't think I've seen anyone posting on here that has had a decision made (from a postal application) within 28 days! My wife, who applied during the week quoted, is now into her fouth month of waiting!!

Incidentally, they state that the figures quoted are for completed cases only.

I don't know about November timeline, so cannot help you there. The answer to your question, though, is "Yes". Everyone has to submit Biometric details again! I think it is a bit silly, because for those that submitted their Biometric details previously, they are all held digitally/electronically anyway. My wife, however, thinks it is logical and done to prevent possible fraud, so she could well be correct in her reasoning
