FLR(O) Under PSW Visa

Post by vish.sara9 » Thu Jan 03, 2013 7:31 am

Hi, Is it possible to apply for FLR(O) before my PSW visa expires as my baby is due just before my visa expires and for medical reasons we three cannot fly so soon, and the baby's passport also needs to be sorted, my wife too has PSW Visa, if we can apply, how long can we apply for?

Thank You

You can apply but it will be refused. Be careful; a patently frivolous application of this nature may impact on further applications to enter the UK. You have known that you are pregnant for a very long time so it seems right and reasonable that you should have planned for this event with regard to your immigration status and its expiry.

Hi,
Thanks for replying, yes we were aware of the visa status but until lately we did not realise that the company we are working for cannot help us extend our visa (cannot hike our pay by £161/month to meet the SOC code criteria) which is very frustrating, so this was not our intention to apply for FLR, and we are in a situation where we cannot fly now and are forced to apply for some visa rather than overstay and put ourselves in trouble.

It will not be granted. Why can't you fly; when is the birth expected?

Pregnancy conditions - British Airways
For uncomplicated single pregnancies, we restrict travel beyond the end of the 36th week, and for twins, triplets etc., beyond the end of the 32nd week. After your pregnancy has entered its 28th week, we ask that you carry with you a letter from your doctor or midwife, stating the pregnancy is uncomplicated and confirming the expected date of delivery. In this letter, your doctor should state that you are in good health, that they are happy for you to fly, and that (in their opinion) there is no reason why you cannot fly.

Dear Guru's,
I made this FLR(o) application as mentioned earlier, with my wife as the main applicant and me as a dependant. My query now is, if my company is willing to sponsor either of us now, can I vary my wife's application grounds and I can still vary my application too as a dependant or vice-vera (me being main and her dependant)? Or I will have to go back to India to apply for a dependant visa?
Kindly put some light on this for me.
Thank You

Yes you can vary the flr(o) apllication to tier 2 with all Depandant at same time.
In ur case if u want to apply from uk ur wife should be main applicant .
