diane - where have you seen such a trend? My understanding is that a COA should be issued once an application is received and a cursory check of documents is performed. The right to work will depend on the category under which the RC was applied (e.g. married or unmarried partner, or primary carer for a child).

I understand you applied as an unmarried partner, but your COA did give you the right to work - as far as I can see from everything the UKBA have published, this is certainly an exception (posisbly an error) rather than the rule.

I have also applied as an unmarried partner, and my COA states the following:

The UKBA will not issue a COA with a right to work if:

a) The applicant is seeking to remain in order to provide day-to-day care for an EU citizen child who is exercising European free movement rights in the United Kingdom as a self-sufficient person. In these circumstances any right to work will depend on your having some alternative basis of stay in the United Kingdom which does not prohibit access to employment or self-employment. Permission to remain may be given on the basis of your caring responsibilities but will not include any entitlement to work or to access public funds.

b) The applicant is the unmarried partner or an extended family member (for example, the brother or sister) of an EU citizen who is exercising European free movement rights in the United Kingdom. In these circumstances there is no automatic right or entitlement to live in the United Kingdom with the EU citizen sponsor. The Home Secretary must consider whether, in all the circumstances of the case, it would be right to issue a Residence Card on this basis. This means that until we have determined that you qualify as an unmarried partner or as an extended family member by issuing a Residence Document, you are not able to work on the basis of your relationship to your EU citizen sponsor. Any right to work in the meanwhile will depend on your having some alternative basis of stay in the United Kingdom which does not prohibit access to employment or self-employment.

c) The applicant has not provided satisfactory evidence of his or her identity or of his or her relationship to an EU citizen. We will consider your application but may need to contact you for some additional or alternative evidence. Until work on your application has been completed we will not be able to provide confirmation of your current status. Any right to work in the meanwhile will depend on your having some alternative basis of stay in the United Kingdom which does not prohibit access to employment or self-employment.

Hello,

happy new year everyone!

I will be applying for a residence card. what are the necessary documents aside from my passport and marriage certificate which testifies that i am a family member of the EEA national?

Advice needed.

i sent my application in july too.. 26th july and got coa with rights to work on 28th aug.. hoping to get rc coming week..

I understand you applied as an unmarried partner, but your COA did give you the right to work - as far as I can see from everything the UKBA have published, this is certainly an exception (posisbly an error) rather than the rule.

This is definitely not an error- I applied for RC as an unmarried partner twice. First time after receiving COA that didn't state my right on employment they refused to give me RC. I reapplied following my lawyer's advice and this time i received COA with a right to work.

Hi everyone I rang the European Contact Enquiry line yesterday 04/01/2013 and they answered the call in less than 2minutes. The representative was polite and a good listener. I told him I have applied since 27th July 2012 and this is the 6th month according to the law but I have not received any response from the UKBA and I also requested for my wife's passport to be returned so she could travel for the Xmas as I was working as per double pay things lol. but yet no reply. After he did checks on my details and confirmed my application he then advised me to email the UKBAeuropeanenquiries@UKBA.gis.gov.uk. Quote my case ID, name, D.o.b, and address and i should tell them my 6 month will lapse on the 27th of this month and yet I have not seen anything that when they receive the email they will see to it and contact me if needed and if not they will know what to do because they can't see anything on the system except if the 6months is completed then he can give information. I have email them but there was no auto reply/response and I don't know if this is normal and I am sending a recorded post letter to them on monday morning as follow up so I hope this helps.

Fingers crossed hope we receive our RC in the new week. Good Luck.

I applied for RC as non-eu spouse of eu national using EEA2
applied May 10th, 2012
UKBA claimed to receive June 1st, 2012
Got COA september 12th, 2012
Got MP involved December 13th, 2012 (MP hasnt done nothing yet though)
Got letter January 4th, 2013 saying wife withdrew sponsorship
wife got letter and all submitted documents saying the same thing
i live with wife and there was no time she withdrew application.
I have series of important job interviews and i need help with UKBA. what do i do?
January 4th, 2013 sent letter refuting claim of withdrawal of sponsorship. Wife and me. we have sent back all documents to them. Any other advice

2 questions and looking for advice

Please can some one answer my two questions about RC

1 - When We receive Rc will be sticked on passport straight away or will be like small visa inside passport pages not sticked and u can use it suparately or stick it your selve?

2- If RC Will come sticked in the passport page knowing that my passport will expire in two years and the RC Will be for 5 Years.
so when this passport will expire and i will make new passport do i have to make an other application with same folders and papers like you applying RC for first time or all You will need is to send the new passport and they will stick the same RC On it as they already have this in system ?

so can some one answer me because if i will need to apply again after two years with new documents and papers AND WAIT OTHER 6 Months will be better to request my passport back and receive my RC in A4 Paper

Hey Dz.man,

It does not matter whether your passport expires, you can still carry it around with your new passport to prove that you still have a valid visa. That being said, it's up to you whether you'd rather carry around two passports or a passport and a separate card.

Just registered as I find this website very helpful, and also wnat to share my timeline (well, my wife's application):

I am portuguese and she is Mozambican. I am a full time university student and part time customer service advisor work 16 hours a week.

EEA2 application sent: 30/11/2012
EEA2 application received : 03/12/2012
COA: 04/01/2013 (Dated 2nd January 2013)
RC : 19/03/2013 (Dated 11th March 2013)

Iam non-EEA family member(Husband) of EEA national (Greek)
Application (EEA1 nd EEA2) sent 30 of Aug
HO recieved 31st Aug
COA recieved 18th of Oct (issued date 12 oct)
RC recieved 09 jan (today) :)
its lucky day for me nd my wife...
We never tried to contact them and no lawyer...

Good afternoon,

I just call now UKBA because of the RC Card my wife received.
She received on an A4 paper while UKBA had her passport with them.
UKBA inform me they start recently issuing on an A4 paper for everybody.

Can any body inform me if is the case? If anyone had received on an A4 paper last 3 months while UKBA had there passport..

EEA2 application sent: 24/05/2012
EEA2 application received : 25/05/2012
COA: 21/08/2012 (Dated 17/08/2012)
RC : 09/01/2013 (Dated 19/09/2012)
UKBA keep all her document for all most 4 months after decision has been made.

Once the 6 month has been passed I send them 2 letters, 2 email and involve my MP for the dalay.

My advice is to request your passport back as soon you receive your COA if they issu the recidence card on an A4 paper for everybody..
