reply from Casework Team

Post by rsathish » Wed Jan 16, 2013 9:56 pm

Had emailed the Chennai UKBA saying that the status is still as "Still under process with British High Commission" and it is now past 60 working days (12 weeks) since the application was made.

So, as this is now past their service standard (as per http://www.ukba.homeoffice.gov.uk/count ... ng-times1/) and since, we haven’t see any news item explaining this delay, I asked them to provide us with an update.

Their reply along with their ref number was,

------------------------------------------------------
Thank you for your e-mail.

In order to assess your application we need to carry out further enquiries. A decision on your application shall be made as soon as we receive the results of our enquiries. I am afraid it is not possible to tell you exactly when we will receive these results. However, we will contact you as soon as a decision has been made.

Yours sincerely,
Casework Team

What to make of this? seems like a standard reply..

Chennai is now well known for sending out these standard replies.

Its good that at least you received a response - be ready for another email in the next few days saying that a decision has been made.

Where the person is in salaried employment in the UK at the date of application and has been employed by their current employer for less than 6 months their gross annual income will be total of:
1) The gross annual salary from employment as it was on date of application
2) the gross amount of any specified non employment income
3) the gross annual income from a UK pension

What does point number '1' means?

Did you include any documents to show proof of contact between you? These can include letters, cards, phone bills, emails, Skype records or Facebook timeline or messages.
These come handy when they balance the probabilities in deciding that you are in a genuine and subsisting marriage.

my document list is below, now this is to the best of my memory! ... i had summarized this in a covering letter and will try and find that for you ... in the meantime ...

- Indian Passport (Spouse - all passports held)
- Passport size photo (as explained in UKBA guidance)
- Tuberculosis Certificate (from the UKBA approved clinic)

- Evidence of Marriage:
- Original Marriage Certificate
- Original Marriage Invitation Card
- Marriage Album (Mini Version - We had a full sized version and mini version, so submitted the mini version)
- Name Change - Since my partner preferred to change her surname after marriage, a gazette copy showing name change was provided. The new passport with name changed was the latest passport.

- Evidence of Current Education
- Since my wife is pursuing her MS General Surgery, letter from institution on course duration and course title.

- Letter of Support from Sponsor (From Work E-Mail ID)
- Basically confirming sponsor's job title, duration of employment, pay and benefits, etc (not sure if required but submitted to mainly show that sponsor is in employment!)

- Evidence of Sponsor's Current Immigration Status
- Full Photocopy of Sponsor's current and previous passports (notarized copy by Indian Lawyer)
- Passport Size Photo of Sponsor (not sure if required but submitted)

- Spouse Meeting English Language Requirement
- Submitted original degree certificate (MBBS) with a screen shot of UKBA points calculator showing that it meets English Language Requirement.

- Evidence of Meeting Financial Requirement
- Sponsor's Bank Statement showing Net Pay (highlight this so it is easy to find) for last 12 months.
- Sponsor's Pay Slips showing Gross Pay and Net Pay (if issued online, get the Company HR to sign, stamp and date this document) for last 12 months. This should match Bank Statement
- Letter from Company confirming the gross pay, net pay, job title, job duration and permanent job status. This should match both above documents to the penny.
- Employment Contract Letter (again not sure if this is required)
To be on the safe side I submitted 12 months (6 would have been sufficient in my case)

- Evidence of Suitable Accommodation
- NOC from Landlord
- Tenancy Agreement confirming that I live in a one bedroom flat with 1 lounge and Spam area all for myself!
- Highlight on bank statement monthly rent paid to landlord.

- Evidence of Subsisting Relationship
- All tickets of trips taken together (Honeymoon, short trips)
- Photos or Collage showing place visited in the trip
- Bookings of Hotels, Receipts, Payments made to Hotels (not sure if required)
- Sponsor's flight tickets to India from UK for purpose of trip.

- Phone Calls
- All phone bills from UK Phone Company covering the period of relationship were provided (12 months).
- All Phone from Indian Phone Company were provided which showed the number was registered in my wife's name (not sure if this was required)

E-Mails
- We don't really e-mail each other, so few print-outs of e-mails were provided.

Hmm, cant think of anything other than this .........

that is odd, i didnt submit the SU07 form ... but my employer letter had clearly distinguished between gross pay and net pay as the UKBA guidance states the letter should clearly mention this ...

My employer mentioned on the letter £45k annual salary. Do you think this will be a problem?

Hi srik_1983,

Thank you very much for your list. It was really helpful. Much appreciated.

I have few more queries:

1)Can you please tell me what other docs you got notarized copies other than passports. Is it mandatory to get it notarized?
2)Did you wife got ILE visa?
3)Can you please send a template of covering letter and sponsor letter to my personal email id: senthilkumar.s.shanmugam@gmail.com
4)Can you please tell me whether you have submitted originals or photocopies or both of all the documents?
5)Do we need to get the sponsor letter notarized?

Kindly clarify. Looking forward for your response.

Thanks in advance.

Regards,
Senthil

My wife got application approved today

Type: Settlement visa application
Date of application: 17/10/2012
at VFS Delhi
Visa granted on 17/1/2013
Valid till 17/10/2015

I am a British citizen and she is an Indian national.

PS: I saw her passport and the vignette says entry clearance rather than VISA. Is this normal?

This is what I gave.
Financials

Covering letter
Original employment contract from my current job(since 2008)
Original salary slips for 12 months
Original bank statements for 12 months
Letter from employer ( I was not aware that this letter should state the gross annual salary. My letter just stayed that I was employed .I was worried whether this would be an issue but luckily the job contract covered it. I would suggest that you get your employer to write the following
Nature of job
Permanent/ Temporary
Date of starting
GROSS SALARY (spend almost 3 months sleepless since my employers letter did not have this. Ensure that the words GROSS ANNUAL SALARY is on the letter)
Original income tax statements for last 2 years

Accommodation

Tenancy agreement
Letter from landlord stating that he was happy for my wife to stay in the flat with details of the number of rooms

Legality of marriage
Original Marriage certificate ( We got married under the special marriage act)

Legitimacy of marriage
6 or 7 emails to my wife and vice versa
Phone bills for last 6 months
Tickets for my trips to India
Our travels in India during our honeymoon( airline e tickets containing both names
hotel bills
Photos from wedding reception

My wife had also given IELTS and she had also submitted the TB test
