PSW APPEAL DISMISSED - LACK OF FUNDS: Need Advice (Urgent)

Post by sadstory2012 » Thu Dec 27, 2012 11:25 pm

Hi guys,
My Application (finished Masters in Uni.) for PSW refused :( due to lack of funds for few days during the 90 days period. Also my appeal dismissed by Tier1 Tribunal. Then I request permission to make another appeal for Upper tribunal... and waiting now for their feedback....
Guys I have no solicitor due to the cost, I just need to know does anyone have idea about this situation. Do you think I have a chance in Upper tribunal in my favour? . Because Im in doubtful mind  whther I go back to my country without wasting more time here or stay until the decision....appreciate any advice or comment.

An appeal to the upper tribunal can only succeed if there is a material error of law in the decision of the first tier tribunal. Have you identified an error of law in the determination?

TBH I have a minor issue for 10 points for funds. But my question is if people get visa with result waiting (85 points for award).. so thats y i thoguht to go to upper tribunal..... i have finished the masters degree before application , only problem was maintenence funds.... as you saying there will be no favour to me in Upper Tribunal as there is no error of law in the determination....

My, request to apply for Upper Tribunal has dismismissed by Tier1 Judge and senta letter dated 11th Jan. 2013. And allowed to apply UT directly.
But i decided to leave UK and for my knowledge I've 28 days to leave the country.
When I tried to contact HO voluntary department team they said they cant confirm anything. But i sent a mail confirming im leaving within 28 days.
cant believe even they dont help to leave the country.
Can anyone confirm pls am I right abt 28 days or should i leave earlier, coz I dont need any problem in the Airport.......

Basically, a stay that is for 28 days or less will not harm any future applications. To stay longer than this may result in a ban on re-entry for a statutory period.
