And what do we see, some applicants from late august already got their approval, meanwhile applicants from early august are still waiting. Moreover, SET (M) applications are assessed quicker than SET (O). Both examples are obvious breaches of equality. Legitimate ground for claim.

Hi,
Thank you everyone for the helpful information on this website. Here is my time line.

Set (M) NO Dependants
The current spouse Visa then was Expiring 26/06/2012.
25/06/2012 Application sent via Next Day Special Delivery.
26/06/2012 Application received by UKBA.
27/06/2012 No Money Taken Out of my Account even though there was money in my account (Debit Card).
02/07/2012 Acknowledgement Letter received (letter dated 28/06/2012).
16/08/2012 Application sent back to me invalid as they could not take the application fee from my card. A simple phone call would have resolved any issues but UKBA don't do the simple things and sends back my application after 7 weeks.
17/08/2012 Sent in a fresh application with a cheque payment so they can't scr£w that up.
20/11/2012 2nd Biometrics Letter received (letter dated 16/11/2012) The letter says I was sent a biometric letter 3 weeks ago even though I never received the first letter!
21/11/2012 Biometrics taken at the post office (chelmsley wood PO)
30/01/2013 Approval Letter (Dated: 25/01/2013) + Documents/Passports (Mine and my wife's)
31/01/2013 BRP Card Delivered by unknown as I found it lying inside the porch. BRP dated 29/01/2012.

I finally have peace of mind after a thoroughly miserable experience. I'm so happy I can travel abroad to see family and friends. I wish everyone the best of luck and hopefully you will get your ilr soon.

Hi,

Just got my Resident Permit this morning. Below is my timeline. Good luck and hang in there! I understand the feeling of anxiety and want to share this with you.

1. Visa form: Set (M) NO Dependants
2. Date of expiry: Spouse Visa expired 05/10/12.
3. Date application posted: Settlement checking service with Hackney Council: 13/09/12 with payment made via the service
4. Acknowledgement Letter by UKBA received 19/09/12 (dated 17/09/12)
5. Biometric letter received: 29/10/12 (date 25/10/12)
6. Date of biometrics Enrolment: 30/11/12
7. Letter from UKBA requiring additional information: 18/01/13 (dated 17/01/13)
8. Additional information posted: 18/01/13
9. Date of return of documents and approval letter: 28/01/12 (dated 23/01/13)
10. Date BRP ILR Received: 01/02/13. (Received a attempt of deliver notice on 31/01/13)

One additional information about the Settlement Checking. There are pros and cos about the service. On one hand, they identified some mistakes that we made on the form and managed to correct it, plus they collected the payment. You get to keep the passport, but you cannot leave the country (well, you can leave, but not come back). However, in spite of the fact that the Checking Service is better "qualified" at knowing which documents are required, we ended up sending less document than we have initially prepared. In the end, the UKBA asked for additional evidence of proof of address. So, we have mixed feelings about whether it was worth paying 100 pounds for this service.

Finally after a wait of 6 months and 2 weeks, I got my ILR.
I was thinking about involving my MP but I didn't. To be honest I don't think involving MP will do you any good as UKBA will take their time.

One piece of advice - don't panic and have patience. It will eventually come whether you panic or not so why not just forget about it and do you work as normal like I did..

Set (0) ILR Post Application

Hey guys I'm new on here.. But just though I'd join and see what others have experienced during their ILR proccesses.

I'm currently a student and was a dependant on my parent's visa but I'm over 18 now and had to apply on my own, I applied by post does anybody know how long this proccess takes? And also how long does it take to get a letter back from the UKBA to confirm that they have recived my application? I posted it by signed delivery!

Baxx, some other good news - my MP's office emailed me today to say they received a letter from UKBA this morning confirming my ILR had been granted and that a letter confirming had been sent.

BRP Query

Cheers Justiceseeker - I was thinking your time must nearly be up with my earlier post as well, since I knew timelines between us were also similar. Truly hope you guys get your deserved responses this week too.

However, as with all things UKBA, there seems to be a twist in the tale... I got an email from my lawyer this evening now telling me my documents have arrived at his office today. Typical that they should send them there - but now I am worried about what happens with the BRP?

Since, presumably, it would require my ID and signature for the courier to hand them over, it would be quite a hassle if this also went to my lawyer. Does anyone know what happens with the BRP when applying through an agent or other authority?

To bring things down to the wire, my girlfriend (dependant on my ILR application) has travel booked for this Friday, so desperately wants to get this back so she can go! [NB the trip was booked nearly 9 months ago, when we first submitted an application and before we knew how useless UKBA are].

and thank you, I feel my time (and justice's and other Aug applicants') is nearer, too. :)

As far as I know all the documents are sent to lawyers (in my case legal adviser) because UKBA processed applications separate if applied via 3rd party, and respond solely to that party, apart from the Biometric letters, which are sent to both.

I think your lawyer should be able to receive the BRP then pass it to you accordingly. I am sure you will hear about it in a day or two, no doubt!

Baxx, I think somewhere in the pile, my application is underneath your. :)

I agree, lawyer is able to receive applicant's docs, at least in my case it is true as I signed power of attorney. Post office employees must be aware of the process, I doubt they will refuse to deliver BRP to a 3rd party. Anyway, Iltowait let us know how it will happen.

Every dog has his day - and today appears to be mine... My lawyer confirmed BRP's were received at his office today, so looks like this saga is finally reaching a conclusion for me after nearly 8 months. Final timeline as below:

Type of application: SET(O)
Type of previous residency: 5 years (Tier 1/HSMP)
Date Applied: 19/06/2012
Date of the acknowledgement letter: 21/06/2012
Payment: NOT PROCESSED
Application returned for failed payment: 08/08/12 (letter dated 03/08/12)

Date Resubmitted: 09/08/2012
Type of payment: Credit Card
Date of payment: 17/08/2012
Date of the acknowledgement letter: 17/08/2012
Biometric letter: 16/11/12 (dated 13/11/12)
Biometrics done: 17/11/12
Date of approval: unsure (approx 31st Jan)
Documents Received: 04/02/13 (received at lawyers office)
BRP Received: 05/02/13 (also received at lawyers office)

After the fiasco of the unexplained failure to process payment (full details were given on the form), we resubmitted in August. In November before our biometrics invitation, we received letters from the UKBA noting us as overstayers and requesting us to make immediate plans to leave the UK. At this (stressful) point we enlisted a lawyer, who quickly established the letter was a mistake since we had an application pending and should be disregarded - no apology for the gross mistake however!
UKBA also advised at that time that as we resubmitted after our visas had expired (due to their failing to process payment and taking 8 weeks to return documents) it was classed as 'out of time' and consequently we had no right to work while awaiting a decision and no right of appeal. Our lawyer immediately contested this but to date has had no formal response. Naturally this posed a significantly difficult situation for us and our employers.
In another attempt to help resolve the matter I contacted my MP on 14th November but his enquiries received no response either until yesterday (4th Feb) when he got a letter advising my ILR had been granted.
I also wrote a couple of letters (and faxes) to complain but to date have had no reply to these either.
In summary its difficult to tell if any of these interventions had any effect on the actual processing time. I suspect not - but it was a useful way for me to vent at the time.

Finally I'd like to compliment this forum which has been a source of much needed well wishes and advice throughout this ordeal. On the flip side it has also caused me some consternation seeing some applications processed much quicker than the rest, causing my speculating mind to work overtime and have an unhealthy obsession with the post.

After the fiasco of the unexplained failure to process payment (full details were given on the form), we resubmitted in August. In November before our biometrics invitation, we received letters from the UKBA noting us as overstayers and requesting us to make immediate plans to leave the UK. At this (stressful) point we enlisted a lawyer, who quickly established the letter was a mistake since we had an application pending and should be disregarded - no apology for the gross mistake however!
UKBA also advised at that time that as we resubmitted after our visas had expired (due to their failing to process payment and taking 8 weeks to return documents) it was classed as 'out of time' and consequently we had no right to work while awaiting a decision and no right of appeal. Our lawyer immediately contested this but to date has had no formal response. Naturally this posed a significantly difficult situation for us and our employers.
In another attempt to help resolve the matter I contacted my MP on 14th November but his enquiries received no response either until yesterday (4th Feb) when he got a letter advising my ILR had been granted.
I also wrote a couple of letters (and faxes) to complain but to date have had no reply to these either.
In summary its difficult to tell if any of these interventions had any effect on the actual processing time. I suspect not - but it was a useful way for me to vent at the time.

Finally I'd like to compliment this forum which has been a source of much needed well wishes and advice throughout this ordeal. On the flip side it has also caused me some consternation seeing some applications processed much quicker than the rest, causing my speculating mind to work overtime and have an unhealthy obsession with the post.

The missed payment was unbelievable, yet no explanation to this day???
Your story will be a good example for all the future applicants to brace themselves for, as well as to tell the rest of the country how badly UKBA is run. Thank you for sharing this with us time and time again.

Does anyone know if receiving the invitation to have your biometrics done means that it is likely you are approved and just waiting for the official letter, or could you still be told that you aren't approved for ILR?

I'm afraid not. Simply means it's now in line to be looked at after validity checks.

Nope. I think the biometric letter is sent after confirming you have paid the right fees and the application is accepted for processing. The actual processing starts after they receive the biometrics. So it can't be taken as approval. I have seen few people mentioning here that after the biometrics were taken, they were asked for more documents including one case where they even pointed out that a signature is missing. So this definately confirms that they are only checking for the right form and the payment before issuing the biometric invitations with no additional checks done towards processing.
