EEA2 living under one roof is required?

I will be grateful if you let me know the list of documents required for EEA2 FP on the basis of marriage to EEA national. (We got married last year in England). Currently I am holding Tier 1 biometric resident card (work permit).

The main question is:
We are living separately in different cities for the purpose of job. However, we often meet on weekends. We are not living under one roof, will this have adverse effect on my EEA2 application?

From the look of things these days and the turn of events re EEA 2, I agree with the previous answer, yes. It will raise a lot of questions and suspicion. You might be genuinely married but you will still need to provide very tangible reasons why.

That comment alone would be enough to raise suspicion in my opinion.

Unless u have bills or bank statement with joint names....on same address, but I guess HO wants to see how genuine is ur marriage.

yogsmith,

I am in the same situation. I wasn't sure if it would be a problem, either, so I applied using an immigration agency. My solicitor did not indicate that there would be a problem with us living separately, entered in both of our separate addresses as required on the application form, and did not ask for photos, emails, etc to prove the validity of our relationship. Hopefully everything goes smoothly.

It is kind of frustrating - who's to say that a non-conventional relationship is any less legit than one in which the wife stays home and doesn't make a living or have a career of her own. These are modern times! ;)

These certainly are modern times, and I'm sure it is quite common for partners or husbands/wives to need to work in different locations, and possibly even reside in different locations for work.

However, wouldn't it be normal for there to be the primary family home? Wouldn't the person working away be living in some kind of temporary (e.g. Monday to Friday) type accommodation? Wouldn't there mail still go to the main family home? Wouldn't finances still be shared? Wouldn't there be proof of the travelling to/from the secondary residence?

Congratulation that your RC received on 14th February. It's a very special day for Lovers. :)

Answers to your questions are below.

1. My Tier 1 work visa expires next year in May 2014.
2. We married in October 2012.
3. we never co-habited.

However, I have several documents mentioned below as a proof of genuineness.

> I have train and coach tickets as a proof of travel to each other places.
> We had been to holiday together last year. (plane tickets & hotel booking).
> I sending job application via email in a town where my spouse lives.
> I also have proof of phone calls from phone usage on-line statements in pdf files.
> I have more than thousand phone texts that we have exchanged to each other.
> Photographs together.
> Skype calls and chat history.
> Facebook massages.

I met a lawyer in Birmingham explained my situation. He said, there is no requirement to live together. But he also asked same documents as I mentioned above to prove genuineness of relationship.

We really want to live together but things are not falling in place because of jobs in different locations.

I wish your lawyer become member of this board to deliver correct information. The evidences you are telling are not enough rather the authenticated evidences includes joint bank account, tenancy agreements, utility bills, family pictures etc. Moreover, the manuals you and your lawyer is following I guess must involve a temporary isolation of couple for instance for vacations or temporary job rotation instead of completely living in isolation. Refer to the following manual too.
