ILR. Earliest date to apply for ILR

Initial Tier 1 General Entry clearance visa granted for three years on 08-October-2008
Entered UK on 03-November-2008

When is the earliest date to apply for ILR: 08.10 - 28 days or 03.11 - 28 days?

you can apply 28 days before 08-10-2013

The grace time has given to those who do not meet the criteria of 5 years but it is not exempted to those who can meet the criteria.

No. Anyone who first enters the UK within 3 months of EC can count there residence period from the EC date, rather than date of first entry.
