Dear GURUS

Please respond ASAP as i have options to go to Gulf if i am not eligible for ILR .


I got Tier 2 (General) visa on Dec 1st 2012 initially for 3 years from INDIA. i.e till Dec 2015. Being a Doctor i was on shortage occupation list. I have a query if some one can help....

Am i eligible for ILR after 5 years of stay as i am hopeful that my visa will get extended in December 2015 for for further 3 years under Tier 2 General ?

If Yes then can you please inform which specific rule will apply for eligibility for ILR after 5 years of stay in UK (As per existing Rules)? My salary range is also above minimum salary requirement.

If NO please mention the rule which is applicable?

I don't see any problem after 5 years (as yet ) that you cannot apply for ILR. Current rules for Tier 2 say that you can stay for maximum 6 years on Tier 2 and current rules for ILR say that if you have stayed in UK on Tier 2 for 5 years then you can apply for ILR.
Even I came on Tier 2 as a doctor in oct 2010. But this 6 year rule does not apply for me and you can say that there is something fishy for new immigrants coming after new rules which came in april 2011 and june 2012. There are some possibilities that for new immigrants who are on Tier 2 and on whom this 6 years rule apply, may not be allowed to apply for ILR in future, but that is just an assumption, as you can see why would they make 6 years rule for Tier 2 and keep 5 years rule for ILR as well, that does not make sense. I mean people who are living here for more than 5 years in future can easily apply ILR, why would they like to apply or try to apply another Tier 2?
Even for older Tier 2 people things can go pear shaped any time with current govt.'s outlook, I am keeping my fingers crossed.

Please check rules applying after April 6, 2012.

I think it will be 3 yrs visa + 3yrs extn = Max 6 yrs stay in country, no eligibility for PR.

After 6 yrs stay, 1 yr cooling off period will apply.

That is exactly what I was saying, but I have actually seen this thing written that after 6 yrs, they have no eligibilty for PR. Can you quote the reference?
