FLR M route closed for Tier 1 Dependant?

Post by LostInCountry » Tue Apr 23, 2013 5:55 pm

Previously I thought that there were 2 routes for Tier 1 dependants who do not qualify for ILR at the same time as the Main applicant.
1. Apply for FLR M while main applicant gets ILR
2. Extend T1 Dependant while main applicant gets to ILR

As I read in FLR M guidance it seems the first route is closed now. Correct me if I'm mistaken.

Quoting Guidance Notes ->

"Form FLR(M) must not be used if you are applying for an
extension of stay:
•As a dependant of a PBS migrant (who has temporary
leave or has obtained indefinite leave to remain as a
PBS migrant) - the correct form is PBS Dependant"

Bad news as FLR M meant a lot less fee compared to T1D.

Perhaps we should edit this (http://www.immigrationboards.com/viewtopic.php?t=114832) guidance now.

FLR(M) continues to be possible, if the partner of an ILR holder meets the appropriate requirements of Immigration rules.

You answer yourself: As a dependant of a PBS migrant. When you have ILR your wife will not be a PBS dependent anymore.

Continuating as a PBS dependant may also be possible.
