Hi SHERI268,

We did not submitted any house papers and husband's payslips because it was not mentioned in the list of documents on UKBA site.
we are the owner of the house and the third person bhc naming is the previous owner from whom we bought the house. dont know what search BHC is doing where they are getting previous owner name.

Secondly i got my baby's passport on friday and looking at the decision i felt even mine will also reject. status for me changed yesterdayand i have got my passport today and weird thing is on the same documents they have give me the visa.

Below is the decision i got from BHC with my baby's application.

The decision--

the address stated in your application where u will reside in uk, check undertaken shows that there are 3 ppl staying in the house ...2 are your parents and the third is 'XYZ'.
given to the no of occupants, i note that u have not provided the info regarding the size of the propertyand no independently verifiable evidence to demonstrate that this accomodation is suitable and meet the requirements of 1985 housing act.
Whilst u have provided that the main applicant have enough funds to sponsor you but u have not provided any evidence to show that the main applicant is employed and in reciept of an income.
Given to the abv points i am not satisfy that the arrangements for your care and accommodation in the UK comply with the relevent UK legislation and regulation. you do not meet the requirement of pharagraph 319(1) of the UK immigration rules
the decision has been discussed with the entry clearance manager

Can anyone help me with what search are they doing where they are getting previous owners name

and what should i do ....apeal or reapply ..please advise

Answer:it's mention on UKBA web stie under immigration law paraghraph 319A to k .It's PBS Dependant visa you need to get points on them if you gt all the points you ll get your visa for sure .some entry clerance officer gv you benifit of doubt and approved your application but some doesn't.

we are the owner of the house and the third person bhc naming is the previous owner from whom we bought the house. dont know what search BHC is doing where they are getting prejvious owner name.

Answer: i am just bit confuse about how many peoples are living there right now in your UK house ?? You have to provide them the immigration survey report along with your application and also you should submitted your house ownership documents.

Secondly i got my baby's passport on friday and looking at the decision i felt even mine will also reject. status for me changed yesterdayand i have got my passport today and weird thing is on the same documents they have give me the visa.

Answer: you are lucky you got your visa on same documents .i read that decision now you can do two thing 1 ask them for administrative review with full covering letter explain them about you got your visa on same documents why not you baby ??and you can't leave him alone here or you can submit new application with all the new and supporting documents give me your email i ll fwrd you the list .or if you want i ll post it here tomorrow.

Hi Sher1268,

Thanks a lot for your prompt answers

would like to tell you the case in detail--

i am currently in India

i was on tier-2(ICT) visa in uk since 2010. my baby was born in London in may 2012. i came to india in Jan 2013 for my vacations. that time i didn't get
my baby's visa. my baby just had her passport while coming to india.
i had the plan to get my dependent done(which can only be done when i am in india as i was on teir-2 (ICT). so i thought i will apply my baby's
visa too from india only. and i think thats the mistake i did, things are easier there than in india

is immigration survey report required ... 200 pounds is a big amount :( . house ownership documents alone will not help?

[quote="dovelee"]Hi Sher1268,

Answer: yes you still required .i think you didn't read the decision carefully it clearly says they refuse your visa coz you didn't submit independent house report . If you submit your application with that they will again refuse you.

and do you have any idea where BHC search for the no of people staying in the house. i am asking this so that we can get this corrected for future.

Hi dovelee
They do independent search like electroll, and county council ... You guys should register your vote at your current house address and also check with council about your tax status .....

Hi

BHC only calls for visa interview (tier1 general dependent) when they are not clear about something, certain evidence might not be clear etc, this is good sign that they are willing to grant the visa provided something is cleared.
Just be ready with all details of your application and supporting evidences, she should get visa for sure. my wife just got her tier1 dependent visa granted today, i would be happy to assist you further if required.

all the best.
