Re: Should I appeal or re-apply? Please help

Post by hunter1 » Thu May 30, 2013 8:58 pm

Hi Babz,
Thanks for your suggestion.

My Solicitor said if I submit fresh application based on my current status (my non-eea payslips and comprehensive sickness insurance) for self sufficient route, ukba may ignore or reject the application and it may take another 6 months for decision. I have about £6000 in my savings and £2000 in wives saving. Solicitor said £15000 saving can make a satifactory evidence for self sufficient route as they didn't mentioned any specific minimum requirements or supporting documents.
So solicitor has suggested go with your appeal and provide additional documents. My child birth certificate and my P60 which shows I contributed £3000 tax per annum and I'm not burden on this country. We know the appeal decision is based on previous documents but additional supporting documents will obviously better convince ukba case worker.
Its important to let case worker know my wife is exercising treaty rights either in employment or self sufficient route. So lawfully I should have right to live and work in UK.
When I applied for EEA2 based on wife employment I didn't sent my payslips so they probably thought I'm burden on this country and they found lame excuses to reject RC by saying couldn't verify her date of birth from employer and company trading address is different from registered address etc

chinouk wrote:I believe you can not send supporting document dated after your application, but you can add any new documents which you have not included in your application to support your appeal.

but according to Babz, we cant not add new documents for appeal? please correct me if im wrong.

hunter1 wrote:Hi Babz, thanks for your kind help. Don't they need original documents at oral hearing? If judge asks for original additional supporting documents then what would you do?
Did you re-applied in same route with additional supporting documents?
I also want to re-apply but through self sufficient route (through my employment), because my wife is on maternity leave and she didn't qualified for maternity paye. But when I applied she was working at that time. My solicitor said they will decide based on previous status.
And If I re-apply they may argue that I don't have right to work as my PSW visa expired now. On other hand continuity right to live and work in UK remains intact during appeal. I'm confused so just waiting for oral hearing not reapplying. Any suggestion?
As for appeal, you can't send in new documents. You can only send them documents you have in your possession when you applied(i.e. before the decision date) and these have to be photocopies. These will be part of the documents the UKBA will prepare for the appeal.
In my case,I chose paper appeal and made sure I presented all necessary documents and explained the reason for the appeal in deep.
Anyway, I'll advise you consult with your solicitor(since you already have one) and hear what he says...
You can add new documents provided the date on the document is before the date of decision.

Hi all :)

As I wrote on this forum a few days ago we received my husband's CAO with a mistake on his last name...

Here is the email I wrote for the Home Office:

"I have well received my Certificate Of Application on 28th of May dated from 23rd of May 2013, I would like to thank you for your quick action.

However, as written on my application form and my passport, my last name is .........., the name written on my COA is ..........., I am afraid you wrongly added a “r” in my last name. Please see attached my COA.

Could I kindly ask you to correct my name on your records and send me a new COA with my correct name?

I would also like to inform you that my wife Gaelle .......... (my EEA national family member) started a new job on Saturday 1st of June 2013 as she resigned from her last position and finished her employment on Wednesday 29th of May 2013.

I have sent you a letter on 28th of May (received on 29th of May with special delivery tracking number: ZW.........GB) regarding this change along with the “section 6” of the application form completed with the updated information and filled in by her new employer and her new contract of employment.

Could I please ask you to confirm the reception of this email, the correction of my name and the update regarding my wife’s employment?

Should you need any further information, please do not hesitate to contact me.

Sincerely hoping that you will give to my application your favourable consideration.

Yours faithfully,"

Now I am wondering to which email address I can send it, I've found this one UKBAeuropeanenquiries@ukba.gsi.gov.uk which I believe is the appropriate one, but I was wondering if I could also send it to some more, just to be sure, like public.enquiries@homeoffice.gsi.gov.uk mark.sedwill@ukba.gsi.gov.uk he is the Permanent Secretary of the Home Office. I've tried few other email addresses as a test, sarah.rapson@ukba.gsi.gov.uk sarah.rapson@homeoffice.gsi.gov.uk alex.norton@ukba.gsi.gov.uk alex.norton@homeoffice.gsi.gov.uk (he is the person that signed the COA) but none of them worked...

I've also found a link with branch contact details here http://www.pcs.org.uk/en/home_office_gr ... -details-/ but the EEA2 applications are dealt by the Liverpool office, so I don't think it could be really helpful...???

Where would you send it?

Thanks for your help :D

EEA2 App sent: 30/11/2012
App received: 03/12/2012
COA received: never - they sent it to the wrong address (I called up after two months and asked where the hell it was, they got the address wrong and said I had to send a letter in to get it re-sent. I did this, never received anything again, called again, they said I needed to send a fax, again, nothing). At least I know they tried to send it!!
RC issued: ????? - nothing and today is now six months. unacceptable :(

Hi everyone, some good news came today.

my case worker sent me the reapplied letter and first apologised for the missing appeal form and then agreed to reconsider my case if I can send the supporting documents to him as soon as possible.

I am quite happy now even its not 100% approve my visa, at least he is willing to look at my case again.

my question is everyone, im still waiting for my partner NI statement to be sent to us, its said might take for weeks, should I wait or should I send the rest documents first?

thanks
