Please help me to find my eligibility for ILR

Hello All,

Thank you so much all for your contributions and valuable answers.

Below is my immigiration detail

Current Visa: Tier 1 General valid upto JAN 2014

Entry Clearance Stamp date: 14 JAN 2009
Date travelled to UK: 16 March 2009

Initial delay between the Visa given date & travelled to UK date: 61 Days
Total days out of the country on vacation [Excluding intial delay] : 105 days
Total days out of the country on Business [Excluding intial delay]: 59 days

My initial visa issued for 3yrs and i did renewed/extended it on JAN-2012. Now my current visa is expiring on 14-JAN-2014.

Now my question is am i eligible to apply for ILR? or should i apply for extension again?

You will be able to apply for ILR 28 days before 14 jan 2014. You dont have to extend your visa.

Just curious and wanted to stay informed to help others. Can you please explain how does they calculate the 180 days period?

Use addition. Don't exceed 180 days in any year in the 5 yr qualifying period. Leaves outside UK must be for personal or work reasons, with intention of returning to UK for work.

They are calculated backwards for each year from the date of application.

Q3 - When does my ILR qualifying period start?
There are two scenarios. One is that ILR qualifying visa (e.g. Work Permit, Tier 1, HSMP, etc) was obtained by switching into that category from another visa whilst still in UK. Second is that ILR qualifying visa was obtained out of country. For first case ILR clock starts from the day the passport was stamped with that leave to remain. For second case ILR clock starts from the day when applicant first entered UK on that qualifying visa, subject to the 90 days entry concession. E.g. If someone got Tier 1 visa from out of UK on 1st February 2006 and entered the UK for first time on 20th June 2006, then ILR clock starts from 20th June 2006.

From 28 days before 14 JAN 2014 providing you have had valid and relevant leave throughout.

I have one more question please; My wife came into UK for the first time as Tier1 dependent on May-2013. Which application form should i use for her visa? and can that be done along with my PEO appointment?

She'll have to satisfy a 5 year route to settlement as a PBS dep (assuming she was granted leave before July 2012). She may extend (before her current leave expires) as a PBS dep or perhaps switch to FLR(M), note an A1 English requirement and Financial Requirement for FLR(M). FLR(M) may be more advantageous if your spouse is a doctor of medicine.

I had a work permit then switched to Tier 1 outside of the UK when the WP is still valid(it was faster there). I came back immediately after the switch. In this case when does the clock start? Thanks, Amber

Hello Friends,

Thanks for your help earlier on my eligibility on ILR. I will be eligible for my ILR on DEC-2013.

If i'm right; my wife who came to UK on May-2013 will not be eligible for ILR or ILR-Dependent and so she will be Tier1-General dependent.

When i try to book an appointment for premium service in UKBA.. it asks me to pay the fees of £2589 [i.e. 1426 for main ILR applicant and 1163 for dependent ILR applicant] but my wife isn't eligible for ILR dependent and has to renew her Tier1-General-Dependent visa.. Will this means that we can't book premium service together?
