ILR Eligibility Date

Hi All,

Can anyone let me know if i am eligible to apply for ILR from & After 24th Oct 2013.

Reason for checking the exact date is to skip the English Language requirement test which is being introduced from 28th Oct.


Initial Work Permit stamp date 20th November 2008 in India (Valid til Nov 2010)
Arrived UK on 4th Jan 2009
Converted to Tier1 (In country) on April 2010 which is valid til April 2013
Extension to Tier1 visa from April 2013 to April 2015

Yes as you have a 90 entry concession period and you can apply from 28 days before you qualify for settlement.

Hi Amber,

My Tier-1 Visa stamp Date(EC) :21/09/2008
Date of Entry : 12/10/2008
Tier-1 Expires on 04/10/2013.

According to the Guide , i will fall in the concession period, But should I apply 28 days before 5th anniversary date of visa stamping ( 21/09/2013 ) or Visa expiry date of 04/10/2013?

I mean can I apply from 24th August 2013( 28 days before 21/9/13) or From 6th Septmeber 2013 (28 days before 4/10/2013)?


The guide on page 21 is self explanatory, but I got confused with

F&Q: Question. If I delayed my entry to the UK by less than 90 days, can I still apply at a PEO 28 days before my leave expires?
A. Yes you can still make your application at a PEO 28 days before your current leave expires

Hi Amber,

I'm posting this forone of my friend

My friend came to UK on dependent settlement visa around 28 october 2011 and his wife holds ILR ...He got spouse ILR on 2010 but not able to come so came here on october 2011 and got futher extension after completing 1 year that is last year 2012 he got visa extension..now by oct 2013 he will completer 2 years in UK ..Is he still apply 28 days before for ILR visa in person..Because his visa will get expire only by next year..as he got his flr only last year

TO be precise on dates

Got spouse settlement visa on November 2010
Came to UK on October 2011
Went for FLR on September 2012
going to complete 2 years in October 28 2013

He can apply from 28 days before October 28 2013 subject to meeting the other requirements.

Hi Everyone, i have applied ILR last week and have been granted successfully at Croydon PEO under the 90 days concessional period as mentioned in my original post.

Congratulations. May I ask what date you entered in Section 6.1 i.e. date you first entered the UK? How did you explain that you were applying under the 90 day concession rule?
