Thanks for doing this useful statistical job for us.

I wonder, could it be that some people among 27 pending applications simply forgot to update this forum? I can imagine some people may be happy that the wait is over and forget about going to the forum to update.

It is more than 7 months since the beginning of the year. In confirmation letter Home Office say that 99 percent are decided within 6 months. I don't blindly trust everything they say but it would be too big gap between their promise and reality if there were really 27 pending applications since the beginning of the year.

I hope you're already constantly pestering your local MP. I think it is time for you to lodge a complaint with Ombudsman.

UKBA has put the blame for the continuous delays in processing the applications on Olympics 2012. So, beware of Glasgow 2014 Commonwealth Games coming up next year. If you don't push them now, they'd push you down.

What list of documents you submitted with your application? Do you have any break ? I learnt from this forum that passport and applications form are normally enough for quickest decision.

Hello everyone!
I know it has been asked many times but I need to know one more time please. As I am about to apply ILR on the basis of 10 years LR, my wife and children's visa will expire at the time of application as would be mine. They all are on teir 4 dependents since 2005. I know I must send FLR M with cover letter. Just wanted to know whether I would need to need financial requirements or not and can I apply SET M after they granted FLR M right away or would need to wait 5 years. If old rule apply on my dependents, what reference from rules should I quote to caseworker?
Moreover, what English language requirement my wife needs if any?
I would really appreciate any help, please and thanks in advance.

my name in the excel file for 10 years is dreamingsong. I am still waiting. got a letter from HO around the time when they started dealing with the March 2013 applicants in response to MP letter advising me to wait as it is not 6 months yet.

my interpretation is they are dealing with applications now quicker. But if your application is not straightforward for any reason (could be anything silly) then you are entered into an endless queue waiting for a Senior case worker to look at your case. I guess they have 100 cases per case worker if not more. the waiting time may stretch to nearly a year.

Hello to all guest of this forum, I have a question in regards to my application for 10 ILR. I have already sent my ILR application last month and before sending the application I made a Subject Access Requested (SAR) which I received today. I will like to send my SAR documents to the UKBA as an additional or supporting documentation to my ILR application. Will this be any necessary? All constructive viewpoints are highly welcome and thanks once again for taking the time to read.

You can send your (SAR) if you want for your mental satisfaction but i think that is not necessary because they already have all the visa records of yours in Home Office computer system from where they printed your (SAR) .This is just my point of view.

1. Because they are granted PBS dependent visa before 9th july 2012... you don't need to show the financial threshold requirement. however, you need to prove that you can support them without recourse to public funds..

2. No you have to wait 2 years after your FLR(M) before you can apply for SET(M) for them because tier 4 is not a route to settlement in itself and therefore tier 4 dependent cannot amalgamate their previous stay.

3. she needs A1 level of english language...try trinity college certification they are easy...but if she has a degree taught in english or if she is from the country where english is the main spoken language then she can be exempted...
- however, my advise is to get a B1 level...but that depends whats your future plans are...

Hallo all senior members, i need a small advice please. My set(lr) is still pending and my wife and two kids pbs dependent visa expires end of this month. My solisitor is advising me not to apply flr(m) because he is saying it is for Person Present and SETTELED in the uk and i am not setteled yet and he says lots of flr(m) applications are getting refused on this ground. He is applying on flr(o) for my dependents and saying when my ilr comes because both applications are same fee he will switch flr(o) to flr(m). In this forum everyone is applying flr(m) for dependents so i am really confused what to do. Pls advice me. God bless us all.

Dear Senior members of the forum,

Urgent Help Needed!!


A friend of mine applied for Tier 4 visa and got refused yesterday with right to appeal. He sent his appeal yesterday by fax and ask for a paper based appeal; in other words, he did not chose oral hearing.

He is going to finish his 10 year on 6 October 2013. So he does not have too long for that 10 year to finish. I know he cannot apply for ILR when he has an appeal pending, but if he withdraws appeal when he hit 10 years, he will have no right to stay as soon as the appeal is withdrawn.

Could someone answer these questions:

1. Can he apply 28 days before while his appeal is pending, or this benefit only applies to people who has valid leave to remain?

2. What would be his best choice:

a) to withdraw appeal when he qualifies to apply for ilr? (i think even after withdrawing appeal, he will have the 28 days period that is allowed by long residence, but i am not sure)
OR
b) shall he make an ilr application as soon as he qualifies while appeal pending, and let the ukba link his ilr application to his appeal?


3. How long does it take for first tier tribunal appeal, that is based on paper, to finish? Will he have enough time to finish his 10 years?

Your help is greatly appreciated.

I am surprised at 'anustaya', this application got visa fairly quickly 12 weeks.. Reminds me of old times!
I guess it depends on the case worker and the type of the case. As someone mentioned, if it is straight forward then junior case worker should sieve it through. But then if one case worker gets 100 cases per week. Thats like 20 to decide in a day. about 20 minute on each case. Where they have to make all those checks , earnings inquiry, criminal records, calculate number of days etc!
No wonder the system keeps slowing down, You also have people taking summer holidays and I do not think UKBA has any succession plan to replace and train other temps. So lets wait for all the case workers to come back and start working full steam! What a bloody red taped institution!

Dependant of ILR through the long residence

Hi,
I have couple of queries regarding my dependant if I apply ILR through the long residence route. Currently I'm on my extended Tier 1 General which is due to expire on 20th May 2015 and I'm completing my 10 years on 10th October 2013. My wife is here since August 2011 on my Tier 1 dependant visa and I understand she can not apply ILR at the time I apply. My question is will she be able to apply ILR once I get my visa done. If not how long does she has to wait to qualify to apply ILR?

1. Because they are granted PBS dependent visa before 9th july 2012... you don't need to show the financial threshold requirement. however, you need to prove that you can support them without recourse to public funds..

2. No you have to wait 2 years after your FLR(M) before you can apply for SET(M) for them because tier 4 is not a route to settlement in itself and therefore tier 4 dependent cannot amalgamate their previous stay.

3. she needs A1 level of english language...try trinity college certification they are easy...but if she has a degree taught in english or if she is from the country where english is the main spoken language then she can be exempted...
- however, my advise is to get a B1 level...but that depends whats your future plans are...

Try applying indefinite straight away in person after getting ur wife flr(m) because she has already spent more than 5 years . I did a mistake by waiting 2 years(old rule) but I know many of my friends has done it straight away and they got it.

At some instances this is possible. Read this post to see how your wife can try applying for ILR. Try to book an appointment at Birmingham, as I believe this is the only PEO where applicants are asked to pay the fee after their case is dealt. (Again, this is just a word of mouth)

28 days matter

Hi guys

My 10 years period is going to be on 25 september 2013 and i still got leave to remain until 2016.
I was going through the guidance notes regarding set(LR) of long residence, and it is mentioned there 'you should not apply more than 28 days before the end of qualifying period'.
So according to that if i apply 28 or 29 of august2013, then in that case it would be ok because that application would fall in 28 days.

any suggestions will be highly appreciated.

Apply 1st week of September 2013 .Don't rush .

In guidance notes about 10 years long residence it says besides other things:

 The applicant must not be in the UK in breach of immigration laws except for any
period of overstaying:
o for 28 days or less, or
o if the application was submitted before 9 July 2012
which will be disregarded.
Does it mean the SET O or SET LR application was made before 9 July 2012 and still pending OR does it mean that extension application was made before 9 July 2012 and was out of time?

will there be need to inform home office about cancellation of college license when i submit this new application . I have passed life in UK test .
I do not intend to study in that college anymore they are not showing any intent of running the college in future . after I have submitted this new application will i still need to be enrolled with the college as my previous application was for tier 4 ? however before tier 4 application I was on post study work permit , sec 3c is extending my post study work visa rights .

I just got this forward . Is there anyone that could please guide me about these issues .

Following the recent refusals based on continuous stays and breaks in it, I am increasingly concerned about my ILR (LR) application which is currently with UKBA (submitted 26/7/13).

I had a work permit which was valid till 19/12/12. I submitted FLR (O) application on 17/12/12. I then varied the above application to Tier 2 on 16/2/13.

Has the continuous leave been broken? Should I be concerned l or not?
