I applied tier 1 entrepreneur 07/11/2012 and varied application to ILR on 19/04/2013 got biometric invitation 09/05/13 and don on 16/05/2013 still waiting for HO response asked HO 28/06/13 which application you want to take forward replied 03/07/2013 still waiting for decision send my all passport and other documents with first application paid full new fee could you please share how did you do your application

Dear mianswat thanks for showing me the light at the end of tunnel after reading your time line I am preparing my self for long and souring wait every passing day is hard and painful but there is no other way out just praying for to not have any emergency travel need(insha allaha) Regards Asjid

I know how hard it is and im sure looking at my timeline you can see that i have been through what you are going through right now.
I would suggest to drop you MP an email and seek help.
His letter to UKBA might trigger the process for you application and i think this is what you require in order to get your ILR.

I submitted the following documents with the FLRO application form:

Current and previous passports (all originals)
Last 3 months bank statements
ICFN
Last 3 months payslips

I guess you have to submit your original passports as the HO won't accept photocopies. The application was based on private life and compassionate grounds.

Hello,
I visit this site once a while, and thought my story might help people looking for answer.

I am a Student aged 21 now. I came to this country 12 years ago as a dependent to my mother studying at the time, we lived here for 8 years with only 2.3 months out of this country and then we decided to leave the country as the home office did not allow us to extend our stay with no strong reason, we left the country summer 2009 and the home office had our passports for the entire previous year, when the passports returned we did not have a single stamp to prove we stayed legally, once we went back home, I applied for a student visa and got a confirmation after 5 months wait, after that I came to study here and applied for ILR.

My record :
Applied 20-nov-2012
confirmation : 24-nov-2012
biometric: 19-Jan-2013
ILR: 28-Aug-2013

I visited every solicitor that would talk for free first and all requested ~£1500 and they would take the case with %50 chance it might not work.
I simply applied my self and arranged all my documents all requested the missing files using the SAR request and I got the reply.

Every case is unique , there are bold margins that you can class a case on, and there are other margins that depends on the case workers own experience moral and rule book.

If you think you should be entitled to the ILR and have the right documents go ahead and don't listen to the useless comments others offer to make you give up.

Thanks for reading, I am writing this because I promised my self that I would tell my story once a result is out to help someone else, like the other stories that help me.

I have a total of 18 trips in the past 10 years, all of which i have entry stamps from UK border upon my return, expect for one. This was back in 2004, and it was my first trip outside the UK.

I read somewhere that this was normal practice back then (i.e. only stamp visa on first entry but not subsequent entries). Is this true? has anyone had a similar experience?

FYI- i recieved zero landing cards with my SAR.

Hi Mirk I had the same experience when went back home in April 2004 and came back May 2004 UK border staff did not stamp my passport I only realised it when I already passed border control went back on desk excused that officer and told him what happen and then he explained to me because your visa is already activated on home office system and all the time during the same visa UK border staff only going to put entry date on computer and not going to stamp passport unless you have new visa.I think you travelled on same visa which was given you first time. I think that's why they did not stamp your passport.

Hi Mirak you are well come the only extra evidence I submitted with my application to confirm my 10 year residence other then my passports is a letter from my surgery which shows that since April 2003 to the date of application April 2013 I was registered with them and have been visiting my doctor time to time did not mention any date I personally think we don't need any thing else if we have all old passports but for your peace of mind you can use your university letter and can mention in your covering letter what was the practice those days but not important HO got every thing on there system you will be 100% fine don't worry to much.

Hi what a fascinating and successful story a friend got refusal after 8 years living in UK HO did not give him right of appeal but he could ask court for right of appeal but he gave up left country i wish he had don some thing like you he left country and never try again. good luck in future

Hi mianswat yes it must have been mentally torturing for you as well that's what I feel right now.
I am thinking to contact my MP but the only thing is stopping me that my ILR variation application is less then 06 months. God forbid if i have to wait more then 06 months then I will try MP. Did you do any thing like this or just waited.

Congratulation Mali and Thank you for sharing your story here. You had a long wait of 9 months, did you send any letter to home office to speed up your process? Your statement shows your mother lost ILR? did you try to go in appeal after refusal?

Immigration History

Entered UK on a Student visa on the 21 Oct 2003.

First absence

was from 01/11/2004 till 28/04/2005 = 178 days went back to my country to complete my courses!

2nd absence

was from 04/10/2007 till 30/10/2007= 26 days, upon arrival Immigration officer stopped me and started questions etc, I was working full time, but I will study too ie full time studies.

Case started with HO, and eventually won the case on the sept 11 2008. and passport was stamped by the IO, because I had valid LTR.

Question here: Will I be considered as a UK resident while I was being on a temporary admission ? UK law says, that if someone is on temporary admission and subsequently grant Leave to remain, that residency is not to be broken.

Then I got a job offer in Rep of Ireland with their work permit, I was keep traveling every week to Ireland doing full time job + degree in London back in forth. I completed my degree and earning from Ireland and then changed status from Tier 4 to Tier 1 General. But there are no stamps on my passport showing travel to Rep of Ireland and UK, because UKBA does not stamp your passport when you fly from Dublin to Brittan.

Spent two years in Ireland ie mixed in Ireland and London every week flying back and forth, but I have always the UK resident permit. In 2010 I moved back to UK permanently.

Question here is how do I justify my absence to Rep of Ireland, because I was there 3 or 4 days a week and then 3 days in UK or travel between northern Ireland and southern Ireland every 2nd day.

Subject Access Request copy obtained from UKBA containing my 10 years application timeline. That file includes my court case and my Irish earning details along with my Irish work permit etc.

I simply applied my self and arranged all my documents all requested the missing files using the SAR request and I got the reply.

Every case is unique , there are bold margins that you can class a case on, and there are other margins that depends on the case workers own experience moral and rule book.

If you think you should be entitled to the ILR and have the right documents go ahead and don't listen to the useless comments others offer to make you give up.

congrats my friend,,, u right that ask people for advice but do what u like and whats best for u,,, this given me a lot of hope as well, coz i had a one invalid in time application (fee related) in last 10 years and everybody scared me to death that u wont b able to get ilr but i applied this month and waiting for the outcome,,,

Hi Asjid,
I know how hard it is and im sure looking at my timeline you can see that i have been through what you are going through right now.
I would suggest to drop you MP an email and seek help.
His letter to UKBA might trigger the process for you application and i think this is what you require in order to get your ILR.

Hi mianswat yes it must have been mentally torturing for you as well that's what I feel right now.
I am thinking to contact my MP but the only thing is stopping me that my ILR variation application is less then 06 months. God forbid if i have to wait more then 06 months then I will try MP. Did you do any thing like this or just waited.

Temporary leave is considered as your lawful stay in briton
Your Ireland travels if you do want to mention on a seprate sheet is upto you, UKBA will have to rely on information you provide them as they wont have record of your absence hence they would not be able to refuse on the base of absence as they dont have a proof

My question is, when you came back after 178 days from your country, did you enter on the same visa on which you entered on 21 Oct 2003?

Hi guys, I have been a long silent reader of this forum and I would like to share my story with you.

Facts:


1- 06/09/2012 : FLR(O) application send via solicitor.

2- 10/09/2012 : Aknowledgement letter received.

3- 08/10/2012 : Application return as invalid. Reason:Payment declined.

4- 09/10/2012 : Resend the application with the same payment details.

5- 24/10/2012 : Aknowledgement letter received.

6- 24/10/2012 : Payment now successfully taken from my account.

7- 10/01/2013 : UKBA informing my employer that they cannot confirm if I have the right to work or not and frightening my employer with a possible £10,000 fine for employing an illegal worker.

8- 07/02/2013 : Cancelation of my conrtact of employment

9- 15/02/2013 : Pre action protocol ( PRE judicial review) send to UKBA via solicitor asking the ukba to confirm my right to work or else we will take action to court.

10- 22/02/2013 : Biometric letter send.

11- 07/03/20123: Biometric done.

12- 29/05/2013: Variation of ground of my first application to ILR ( indefinite leave to remain) application send via solicitor and new fees of £1081 pay using NatWest bank draft. this time to avoid any decline or error.

13- 31/05/2013: Acknowledgement letter received.

14- 12/07/2013: Contacted my MP, She sent a letter to the HO regarding my case.

15- 28/08/2013 Received my BRP ILR,dated 23/08/2013 and all my documents.

Hi there

My mum who will be here 10 years in October is looking to a apply for 10 years long residency . She has two de dependants one under the age of 18 and the other 24 years. Both dependants have been in the UK for 6 years and 10 months . They are not eligible to apply with her ( according to the lawyer)


My question is which form should my mum use to apply for 10 year long residency?

Which forms should the dependants use , one over the age of 18 and the other under the age of 18.

Can the dependant under the age of 18 apply together with my mother ?

Hi guykou Congratulation mate thanks for wishing us good luck I am in same situation varied my first application to ILR on 19/04/2013 still waiting for HO response first application was made on 07/11/2012 I have couple of questions I am thinking to involve my MP now.
1- Did you send your passports with first application or with variation application
2-Did you do biometrics for both applications or only for first one
3-when you involved your MP did you gave him information and refrence of both applications or only for ILR application

I had extended my visa before going out, so the answer is I had the 2nd visa and on arrival the immigration officer stamped my passport. which is fine

The only concern is how am I going to show that I was flying back and forth to Dublin from London every week, because my family was here and I had to come back every week and sometime work from home remotely.

I had traveled a lot to northern Ireland in working days and over the weekends by car and there is no check post/border control between North & South, its a motorway and you wouldn't even notice when you cross the border, except if you stop in fuel station and they ask you for Euro's then you would notice that you are in Rep of Ireland :).

I think I will explain in an excel sheet every week absence traveled by sea or by air etc etc. All their concern should be that I shouldn't be outside of the UK for more than 540 days in 10 years time.

Besides I can show them my bank statement while I was in the UK at the same time.

Well question is UKBA will only know what info you will provide them as they would not have this information of your visits to Ireland
