Hello all,

I have a question about the disclosure of civil judgements and civil penalties on SET (LR) application form.

Firstly, I don't know what exactly civil judgements and penalties are. Secondly, in the past I have received summons from magistrate court relating to non payment of council tax bills. These arose due me not submitting the Council Tax exemption letters on time.

On all occasions I eventually submitted letters required by the council so therefore never actually attended the Magistrate court. Furthermore, after submissions I never received any correspondence from the court.

I have already applied for ILR but was wondering whether I should have disclosed this information to the HO

Like always, any input will be appreciated.

Yes PSW application was refused on 12 of September 2012, On 10 December 2012 Home Office representative withdraw the appeal. On 16 of January 2013 I received confirmation of withdraw from Tribunal. And then I got another new refusal from Home office same as previous refusal but bit explained. I did not appeal on 2nd refusal. in the mean time I have completed 10 years lawful residence(06/01/2003-05/01/2013). So I applied for ILR on 28 of January 2013.

I missed the DX delivery yesterday so I arrange tomorrow.

Indefinite Leave to Remain (Set (O)) postal applications. This has been dealt with as a
request for information under the Freedom of Information Act 2000. Please accept our
apology for the delay in responding.
Please see the information below in response to your questions.
1. How many applications have you received under the SET-O 10 years long residence
category in October 2012?
Due to the volume of Freedom of Information requests received we are unable to provide
responses to specific time frames or breakdown of application types beyond the application
form used by the main applicant. The information we have provided is by application form
and by month.
I can confirm that we received 2,528 Indefinite Leave to Remain (Set (O)) postal applications
in October 2012.
2. Of those SET-O 10 years long residence applications received in October 2012, how
many cases have you resolved up to today's date 28 January 2013?
Of the 2,528 applications received, 1,894 have been decided. As mention in response to
question 1 details for applications types beyond SET (O) are not available.

3. Once the biometric information has been registered, what is the average processing
time in days for applications submitted in October 2012 to be
resolved?
The average processing time for applications submitted in October 2012 following biometric
enrolment was 111 calendar days.

4. What is UKBA doing to accelerate the applications for the SET-O 10 years long
residence which have exceeded the average processing time of 19 weeks?
The time taken to complete a specific SET O application will depend which route of
settlement is being applied for on the application form, a small number of applications are
currently extending beyond the 6 month target however a plan is in place to bring all routes
back within service standard.

5. What is average processing time in weeks for the SET-O 10 years long
residence applications, which were submitted in October 2012?
UK Visas and Immigration is an operational command of the Home Office



The average processing time for Indefinite Leave to Remain (Set (O)) postal
applications in October 2012 was 163 calendar days which converts to 23.28 weeks .

6. How many staff members of the UKBA are available in processing the SET-0 10
years long residence applications received in October 2012?
The number of staff processing SET (O) applications will vary each day depending on num-
ber of applications and staff availability.
All figures quoted have been derived from management information and are therefore provisional and subject to change. This
information has not been quality assured under National Statistics protocols. Figures relate to postal applications for the main
applicants only. The processing times are based on the average number of calendar days and relate to applications that have
completed that stage of the process only. The data presented was generated on 02 July 2013.

Hello all you good people on this forum.

I will greatly appreciate your response. My wife has been in the UK lawfully since March 2004. She has had several visa renewals within the UK and all the successful renewals has always been submitted in time and granted without any refusal.

Her current leave to remain expires later this month. However, she made an application for FLR O in 2012 which was refused but appeal granted. The appeal is listed for March 2014 and by that time she would have been in the UK lawfully for 10 years.

I have been told that she can amend the grounds of appeal to include 10 year lawful resident as one of the grounds of appeal
1) How do you change grounds of appeal?
2) Does she have to do English Language and life in the UK test? if yes how do you send the result to the UKBA?
3) Does she have to pay for SET LR application and if yes how?

This is important to me as well, can anyone please tell us what we should do, as I also had an issue with cancel tax and was forwarded to the court few years ago :(

Hi Soban civil judgement are if some one or maybe a company or organisation sue you for the money you owe them and if they are successful that CJ goes on your credit history and penalties are for example if you throw cigrats or any litter on street and police or council enforcement officer catch you they give you fine that call civil peanlties you don't have worry about them and no need to disclose them to HO these are not criminal punishments. Going in court for council tax any way three four years ago is not a problem again its a civil metter between you and coucil not crimnal. AS FOR I KNOW
