Totally agree.

Any ideas how to make time go faster? Or think less about it? Except of praying please, I pray a lot anyway.

I applied 2.5 months ago, think about it more and more. Trying not to think does not help. I am normal guy, have hobbies and life but this wait is getting on my nerve.

Criminal Conviction

Hello,

I will be applying for ILR based on the 10 year long residency very soon.

Today I was looking at the application form and section E (Personal History (criminal convictions, war crimes, etc.)) asks for the details of any criminal convictions. It does not specify spent or unspent.

1: I was convicted and fined in 2007 due to a traffic offense in the court. I believe my conviction is spent after 5 years.

2: I also attended a speed awareness course this year due to over speeding. There was no fine or penalty points just attended the course.

Now my question is do I need to mention both of these offenses in the application form? Can it have any negative effect on my application?

Hi meb4ne1 you don't need to show proof of income if you applied on base of 10 years long term residence you have to show income if you applied on base of 5 years work permit or any other work based ilr.

I m going to apply for ilr 10 years basis next week. In set(lr), pg 7, how many previous addresses do we have to provide as I have changed more than 2 addresses in last 5 years but there is space for only 1 address. Thanks

1. Please use separate page to list all your previous address for last 5 years.
2. Please send all your previous passport for 10 years (and list the number of passport in page 25)

Thanks lucky13 for your quick response. Could u please clear it if I have to use extra photocopy of the same pg ( i-e pg 7 of set(lr)) or use blank sheet to write previous 5 yrs addresses. Plus how can I write passport nos on pg 9 (C6). Again do I have to use extra sheets as I have 2 previous passports that have visas on them.

FLR Visa Refused

Dear Senior members. Could you kindly help me with my sons situation. My son now 18 was granted a work permit dependent visa on October 2011 expiring 5 Sept 2013 but came to United Kingdom on 3 Feb 2012.

Applied for his extension visa FLR O on 22 August 2013 after seeking advice from Home Office on which form and category to apply for. Received a refusal letter today with the following reasons

1. It is noted that you entered the UK as a visitor on 30 June 2011.
2 Your application has been refused due to the fact that a variation of leave to remain is being sought for a purpose not covered by these rules.

A. The date of entry is wrong as he entered on the 3 Feb 2012
B. He did not apply to vary his leave but ti extend his visa as a dependent of a person with indefinite leave to remain ( myself) and that was clearly stated in his covering letter.

The Immigration officer also highlighted that there were changes to Immigration Rules changed with effect from 11 June 2012 . My question is Do these changes affect him since he came to the UK before 11 June 2012.

Deadline appeal date 4 Oct 2013 please help with the way forward

Try a reconsideration letter, which is a letter to the United Kingdom Border Agency stating the reasons why you feel your application was wrongly refused, you need to refute all the points made in the refusal letter and state the reasons why.

With the letter of reconsideration you can also attach further evidence to back up your point and refer to it in the letter.

The letter should be sent to the same post which refused your application and to the person and department names of which should be stated at the end of the refusal letter, there is no fee for this and if a decision in your favour is forthcoming then your visa will be granted. You should send this letter as soon as possible.

You can clearly mention that he first entered the UK in 2011 which is Pre July 11 june 2011 hence you believe that he should be considered under old rules. However, it is worth mentioning that you are aware of the changes made to the rules.

The main motto of this letter should be to let the caseworker know that it was wrongly considered under old rules and that you'd win this appeal without any hesitations and that you're trying to resolve this out of court.
(Bear in mind, do not put these words in the letter but some how you will have to indicate without mentioning as if you've whispered)


Rather than going to a solicitor to appeal, try to speak to them (Supervisor) not the CSA and explain to them the situation that they've sadly mistaken the dates. I remember lately someone had the similar kind of refusal and they managed to revert back the decision. (Saving you £££'s). Reading the reconsideration process might help you.

UKBA's Reconsideration policy @ Page 6 wrote:Definition of a reconsideration
A reconsideration is a review by the UK Border Agency of a decision made in the UK on an application for:
 further limited or indefinite leave to remain
 transfer of conditions (TOC), or
 no time limit (NTL).
Such a request will usually be about a refusal decision but may also be about aspects of an approval (for example, the period of leave granted).
When is a reconsideration request acceptable?
The UK Border Agency is not legally obliged to reconsider an immigration decision. When an applicant has a right of appeal, the correct method for them to challenge the decision is to lodge an appeal. Applicants refused without a right of appeal can either:
 challenge the decision through the judicial review process
 make a fresh application for limited or indefinite leave to remain, if they believe they
can show that they meet the requirements of the route under which they are applying,
or
 in the case of refused TOC or NTL applications, submit a fresh application that
addresses the reasons why the original application was refused. The UK Border Agency will however reconsider applications, if:
 The application was granted and the applicant believes that the type of leave granted or the expiry date of the leave is incorrect.
 The reconsideration is a legacy request submitted before 13 November 2012 and there are still reasons to reconsider the decision.
 The reconsideration request is about a case affected by the Alvi judgement and the
applicant is still in-time to bring an appeal or judicial review. For information on how to deal with reconsideration requests based on the Alvi judgment, see related link.
