Hi,

My wp wa issued late 2008 and I enter the uk approximately 2 months after the issue of wp.

I know that you can apply for ILR 28 days before completion of 5 years. Also in the code of practice it says: as long as the first entry is delayed less than 3 months it doesn't count as absence.

So in this case can I apply 28 days before expiry of my visa Bering in mind my visa expires 2 months before 5th anniversary? Anyone know similar examples successful or rejected applications?

Pls state the exact dates - wp stamped, entered UK, WP expiry date

The date of the stamp is 10.10.2008 and delayed entry date is 16.12.2008. WP Expiry 10.10.2013.

No absences other than annual leaves until now.

Thanks wpilr. I guess Wp ec stamp date means my first entry with the wp and the first stamp. it is 16.12.2008.

You will be eligible to apply for ILR from upto 28 days before the 5th anniversary from 10.10.2008 (EC date), as you first entered the UK within 3 months of EC.

Just a quick follow-up question on the same issue;

does the 'delayed entry' make my case complex, what do you think?

I want to apply at PEO and not sure if the UKBA staff at Solihull can make a decision on my application straight away or would they refer it to a senior caseworker because of the 'delayed entry'?

I think you are just getting worried for no reason. They wont expect you to board on the next available flight soon after you got your EC stamp. Your entry is wthin 90 days, so there wont be a problem at all.

Just want to ask the same question with different situation:
my routine is like wp->tier 1(2 years)->tier 1(3 years)

date of the stamp(my first WP): 12.09.2008
delayed entry date: 28.09.2008.
tier 1 expiry some date at February in 2015

when could I begin to count my 28 days?

I have just booked my appointment for 12.09.2013. Fingers crossed things will go smooth.

A few quick questions though;

- when I was booking the appointment there were some notes regarding a payment of £100. However I haven't been asked to make any payments...is this a problem?

- this delayed entry issue...is it something I should mention in section 8b (Other information about the application)?


Want to make things right first time, wasting £1500 would really be painful for such silly things :S

I think you need to pay £100 to confirm your booking other wise home office can cancel your appointment any time.
Re. delayed entry I have a similar situation.. couple of solicitors/immigration consultants I have spoken to are confident about 90days rule as their previous experience was always positive on this. Even forum experience is consistent with this. I have my appointment this week. will let you know that status after my appointment
