ILR dependent help

Post by deepg » Fri Oct 04, 2013 9:39 pm

Hi
Thank you for this forum, it has helped in preparing for my ILR application.

I have the following query on dependent ILR processing. Hope experts can clarify me on this.

I came to UK in November, 2008 on work permit and extended as Tier2 ICT. My wife joined me here in UK on January, 2009 and she went to India 4 times till now, and each time stay is less than 180 days per year. Last time, she traveled to India when our Tier2 ICT visa is about to expire and I got it extended from UK, my wife visa expired when she was in India. Once I got the visa extended in UK, she applied in India and got extension then came to UK.

Now, the question is, I am going to apply for ILR this month end.
1. Since my wife stayed with me in UK more than 2 years, should I go ahead and apply ILR for her as well or will there any problem because of her visa expired and extended later from India?
2. Since her visa got extended in India, she don't have BRP card (I got BRP card for my extension). Will there be any problem as she don't have BRP card?

Thanks in advance.
Deep

When did she apply from India?

It's complicated because "continuous leave" isn't properly defined in this context. However, Sep08T1Applicant was successful.

What I don't understand is on what grounds did your wife got ILR? We are also in same situation. My wife was here for 2.5 years, went home for an year and got second entry clearance in 2013 January. I have no idea on what grounds I can apply for her ILR with me in July 2014, knowing from mid 2012 the qualifying period is 5 years. Confused.
