PLEASE HELP

Post by sean80 » Tue Oct 08, 2013 1:22 am

was granted reconsideration for my psw, so HO requested for my document, submitted all, then i was refused based on maintenace on the 21th sept 2013
with right of appeal. so the question is

1.i applied for psw on the 30th of march 2012 with complete document, i had 1100 pounds as oppose to the 800 requested in my account from 8th dec 2011 till 10th march 2012, and my lawyer even stated they can count from 10th of march upwards or from 8th of dec downwards which is more than 90days requested..but on the 11th to 13th of march 2012 it has dipped by 40 quid from 800pound remaining 760.

then this is HO decision states as follow
WE HAVE ASSESED MAINTENACE FUNDS FROM THE PERIOD OF 15TH DEC 2011 TO 13 MARCH 2012 FROM THE EVIDENCE PROVIDED YOU HAVE NOT SHOWN THAT YOU MAINTAINED THE MINIMUM LEVEL OF AVAILABLE FUNDSFUNDS THROUGHOUT THIS FULL 90DAYS PERIOD AS SPECIFIED UNDER APPENDIX C OF THE IMMIGRATION RULES.THIS IS BECAUSE ON THE 12TH AND 13TH OF MARCH 2012 FUNDS FELL BELOW 800 WITH THE MINIMUM BALANCE BEEN 760 POUNDS.
NOTE, THAT ALTHOUGH YOUR REPRESENTATIVE HAS DATED THAT THEY WISHED FOR THE PERIOD TO BE ASSESED 90 DAYS BACKWARDS FROM 10MARCH 2012 ,IN LINE WITH THE IMMIGRATION RULES WE ASSESS THE MAINTEANACE PERIOD FROMTHE LAST DATE ON THE EVIDENCE PROVIDED ,PRIOR TO THE DATE OF APPLICATION AND IN THIS INSTANCE ,NO BENEFICIAL PERIOD HAS BEEN ASSESSED. SO WE THEREFORE CAN NOT AWARD YOU ANYPOINT ON MAINTENANCE FUNDS.

Thanks for info and congrats kalstime. Can you please let us know about your employment as salaried and / or self employed / company account?

Can we add "Employment" item in this topic (same as per topic for PEO experience)? This info will be helpful to track timelines on applications after rule change from Oct 13.

-- Called my token no within 5 mins - went to counter and taken my applications, passports + photos and spent 20 to 25 mins in that counter.

-- Given me two floders and a rubber band to keep all my documents and asked to go to Biometric.

-- Stright to the Biometric - Spent 10 to 15 min and submitted my documents by keeping all in those floders. he asked me whether im going to stay here(near canteen), or planning to go outside?- told him will stay back.

---Went to Cafetaria area and waited there by watching screens attached on the walls -

-- saw my token progress from Awaiting consideration to under consideration and then eventually to Ready for collection.

---Called my token no, went to the counter -- she told me that my application was successful, BRP CARDS will be sent soon.

Overall very good experience, no hiccups and no hassels.

Thank you very much for each and every person in this forum and really appreciate your responses.

Tier1 2nd Extension

Post by hey.razi » Thu Nov 21, 2013 8:41 pm

Hi All,
I know it is a wrong forum to seek help but i thought it worth asking. I am going to apply for my 2nd Tier1 Extension. My case is quite straight forward. I have completed all the documents. My question is here that when they will deduct my fee my account balance will be negative. I have already submitted 92 days maintenance fund. Can it be affected on my Application?

My 2nd question is that I am going to skip my uk born child extension as we don't have any plan to go outside the country until next year (My ILR due). Is there any impact on my Application or ILR application if I don't include my child, although she has been granted visa as my dependent.

Your advice will be much appreciated.

Many Thanks
Razi

Hi,

What I feel that you should have enough money to not to go in negative balance atleast.

2ndly, if your daughter is in UK and her visa will expire with you then it is strongly advice able to apply for her visa extension too as otherwise her status will become illegal and the same question will arise by the CW.

Thanks

You might find this relevant to yr application.

Restrictions on reapplying
If we have refused your application because you, or another relevant person, have been issued with a civil penalty for the maximum amount under Section 15 of the Immigration, Asylum and Nationality Act 2006 or the Accession of Croatia (Immigration and Worker Authorisation) Regulations 2013 for employing one or more illegal workers, you should not reapply until 6 months after the relevant penalty was issued.

Hello Dear Members,

I am due to apply for my 2nd Tier 1 (General) visa extension in the 1st week of February and as I have been in contract for over 1 year now operating on a limited company model, I would greatly appreciate if one of you who have already had their visa granted, post a format of the cover letter, dividend vouchers, accountant letters etc.

Cheers
Vishnu
