ILR start date

Post by sunnyday » Thu Jun 14, 2007 5:33 pm

I know this might have been asked on this forum but am having troubles digging it out through pages after pages.

You should apply no earlier than 28 days before the completed period. Do you count from the day you first entered the country or the first date of entry stamped on your visa?

My understanding is it is 28 days from the date that is stamped on the passport (ie Visa) as was initially said above. Why do people like to confuse others?

you confuse yourself.

You should make an application no earlier than 28 days from the very first day you entered the UK, not the date stamped on your passport.

It could be the confusion that people think the date stamped by the IO when you entered the UK and they are calling it the date stamped on the passport.
It would be more clear to say the issue date of the visa (which is sticker stamp in the passport that normally has a printed date of issuance and expiry) versus the date of entry into the uk (which is date stamped in ink by the IO)

Sorry I should have been clearer ( had a tiring day).

I meant as above 28 days from the date of issue of the visa. That's why if there is a large different between date of issue of visa and date of entry into the UK then you may get caught out and have to apply for FLR.

Is that correct?

I thought they have made it very clear that it's the first entry date into the UK that counts, not the visa issuance date. If you're given a visa tomorrow, and enters the UK the day after, then it starts from the day after.

Hi,

My situation is I was on a dependant Visa then switched to a Work Permit being in the UK.
Applied for my WP being in the UK and got my WP in Aug 2004, but then had to send my passport for stamping, which was returned in Dec 2004, so when should I be applying for my ILR?

Nov 09 or Jul 09?

Thanks
Krish

I called HO to make an appointment. With regard to the starting date of five years for those in-country applications, I got three different answers: (1) LTR stamp date (2) actual working date (3) work permit date.

Don't bother to argue with them, just make another call until you succeed. I got my appointment based on (2). My experience tells there is no consistency there, so please do not stop trying your luck.

Another confusing question on the ILR form?

When did you first enter the UK?

For someone who swithched from student to HSMP........

Is this the first date of entering the UK as a student?
Or the date of starting on HSMP or WP for example..?

Thanks.
