EEA National exercising Treaty rights

Post by srivathsa » Wed Nov 20, 2013 10:31 am

Hello All,

A friend of mine who is a EEA national has been living in the country since Nov 2007 and wants to apply for naturalisation now. She was a student from 2007 to 2010 (with a yellow card) and has been working since then, albeit with a gap of 1 month in Aug 2010 (no CSI) within the 5 years period.

Would that break of 1 month with no CSI be seen as a break in 5 years period?

Also, she had few months gap in the 6th year (post PR assuming she had completed 5 continuous years and hence qualified for PR). Would that be any problem?

Your help would be highly appreciated, thanks

Sri

Why does she want to naturalise? She may be better simply applying for a permanent residence certificate as evidence of her right and basis of residence.

She wants to get a British Passport eventually, which she feels will help her in her Masters/PhD studies in the US and the option to move to different countries with less visa complications.

The question of 'break in work' would apply even when going for permanent resident card as she will have to prove her 5 years in the UK.

So, she is just worried about the small gap, which could become a major factor in determing her 5 years.

Did she obtain a right to work, or was she simply relying on the Registration card given to her as a Student

I think she did get the right to work. She got the Blue card in 2009 when she was a student and was working part time as allowed by the regulations. She started working full time in 2010.
