Condition In Netherlands for Issue of Lawful Residence Spous

Post by confusedinpakistan » Thu Nov 21, 2013 1:20 pm

Hello,

My wife is a British national and we are considering moving to the Netherlands to take advantage of the surrinder singh route.

I have a question. I (Pakistani National) would obviously need to get a registration certificate if we have to stay in the Netherlands for longer than 3 months.

Does that mean that my wife would also need to get a registration certificate first or can I apply without her getting it first?

The reason for the confusion is because on the site it says the following:
You are the spouse, partner or registered partner of an EU citizen.
You must meet the following conditions:
  • You are the spouse, partner or registered partner of an EU citizen.
You are not a risk to public order or national security
You have a valid travel document (for example a passport)
Your spouse, partner or registered partner must meet the following conditions:
  • He has an EU/EEA or Swiss nationality
He has lawful residence in the Netherlands
By lawful residence do they mean that she has to have a residence card?

Detailed information about the procedures in the Netherlands can be found on https://ind.nl/en/individuals/residence ... -nationals
You can travel to the Netherlands at the same time as your spouse; make sure that both of you register yourself as soon as possible after arrival at the local municpality (gemeente), by doing so your spouse will already have lawful residence, and then start the procedure for verification against EU law.
