Pls tell me Earliest time to apply

Tier1 residence permit :- 10-June -2009 to 10-June -2012 (applied for extension on 19-May -2012)
Tier1 extension date. :- 9-October -2012 to 8 -October 2014
My question is there is a gap between 10-June -12 & 9-October-12 (4 months)
So what is the earliest date for ilr can I apply on 13-May-2014 (after 4 year 11 months from 10-June-2009) or i have to wait till October 2014.

How home office will consider this 4 months gap.

Why do you think there is a gap? If you've posted your application on 19 May 2012 then you were covered by virtue of section 3C of the Immigration Act 1971 from the Legislation. So no gap.

Yes, you are eligible to apply anytime after 13/May/2014.
