If your appeal is withdrawn by HO then you won't get the refund

seems a bit long for a withdrawn one than I was thinking. Did you try writing to your case worker at all or any other attempts?

Hi guys,

I applied in nov 2012 . Got refusal in may 2013. Then appealed in may 2013 and got hearing date in nov 2013. But HO withdrew the appeal in oct 2013. Since then I have heard nothing from HO. My solicitor wrote to the HO lawyer in dec 2013 but still there is no response. What should I do now?

Should I write to the court or get help of MP.

yeah mine got withdrawn by Home office over a original decision in Oct. too no news thus far as far as I know I should not write anything to Home office unless 6 months gone passed however I spoke to them on the phone just a week ago the one who answered the phone said that there has not been any activity on your file since withdrawal as system showing it as in process.
I spoke to a lawyer as well he says unfortunately there is not anything an applicant could do and make this process quicker.
the way I was answered and details provided seems that the case worker to my case does not even know if there is case that has come back and needs attention.

hoping.. it aint gona stay the same for long
thanks,

Hi guys,

Hope you all would be good, I am usually a silent reader of this form, need some information regarding my entrepenurer application.

Applied August 2013
Refuses late august 2013
Reason: services not clear on contract.(funds in UK bank)
Appealed next day.
Hearing 28 nov 13.
Appeal withdrawn 2 days before the hearing day.

No response yet, my solicitor is asked to wait initially then he wrote to home office twice and I myself faxed a letter to HO but no response. Is there anything we can make this process quicker with home office?

What a time waste and resources they are doing to us.

Kind regards.

Hi, my i had my hearing on the 21st of Jan 2013, and Home office withdrew it at the of hearing, saying that there are some contradiction in the refusal letter and reasons, hence withdrawing after consulting the senior Home office rep,
what will happen next

my refusal points were

no contracts submitted ( however they din't pay attention to it and found 3 bunch of contract papers in the home office bundle, which i submitted with my initial application , so obviously they took wrong decision )

2) current appointment report not submitted however submitted directors consent letter and other company documents , like Certificate of incorporation , address registration cert, director's consent letter, Share certificate , they din;t apply evedential flexiblity
and refused my application,

can they refuse me again on the same points on which they have withdrawn the case, because i am 100% confident that they can't find any other reason for refusal?
or can they ask me to send updated bank statement showing 50k or businees activity ?

kindly reply
Atif

Mine and my wife's application for leave were refused after 13 months delay. So we appealed but before the hearing date we both reached our 10 years lawful residence. On the day of hearing in July 2013, HOPO asked for the adjournment. Tribunal accepted it and directed to verify our claim and grant us ILR if we were qualified but if not then supply the reasons by August, 2013 and had set a date in Oct, 2013 for second hearing. In Sept, 2013 HO informed us and the tribunal that I was qualified for ILR but I needed to submit another ILR application. But my lawyer wrote to the HO with relevant rules and HO guidelines to explain that it was not possible while the appeal was outstanding and to grant us ILR, according to tribunal direction.

No answer from HO and they had withdrawn a day before the second hearing in Oct, 2013. Since then no response from HO. We shall be completing '11 years lawful residence' in a week time............
