Can you please confirm whether we need to provide evidence of absences when they are under the limit? I mean none of my absences are more than 90 days (the longest one is 32 days) and I have not been out of the country for more than 180 days.

This particular area is very confusing as hardly there is any clarification anywhere, hence, need an understanding because all my absences were with my previous employer and it is not possible for me to get a confirmation from them.

I have asked this question multiple times, so, please pardon me but, as my PEO appointment is on 6th Jan, please confirm what is the best thing to do.

Please could advice for queries(Tier-1 ILR) given below:

Question For Main Applicant

Q1 - I have given the dates of visa stamping for my Tier-1 as below:

Date of first Tier-1 stamping - 01/03/2009
Date of first entry in UK - 15/05/2009
Visa Valid until - 01/03/2012

Date of extension - 03/04/2012
Visa Valid until - 03/04/2014

If you observe the dates of extension, i have got a grace of 1 month, as i had applied for extension by post.
Considering the dates, as per the date of stamping i will complete 5 years on 01/03/2014 and as per date of first entry in UK i will complete 5 years on 15/05/2014.

As per 90 Day rule, i should be able to apply for ILR 28 days before(expiry of current VISA validity) 03/04/2014.

I would like to know, if my understanding correct?

Please could you provide expert advice.

Question For Dependent

Q2 - My wife joined me in UK on 01/08/2011 and stayed in UK until 06/09/2012. She went to India to deliver the baby and returned to UK on 06/08/2013 (after a gap of over 11 months).
Now, as per rule dependent should have spent 2 years in UK with main applicant. But, on 03/04/2014, my wife would complete 1 year and 8 months in UK with me.

Can she apply for ILR with me ?
If no, then can she apply for Tier-1 dependent extension? (I assume For this main should also be applying for Tier-1 extension)
If she cannot apply for Tier-1 dependent extension, then in that case i have to go another extension with my wife. Is my understanding correct?

I would like to know what is maximum absence duration from UK for ILR dependent (considering dependent should be in UK with main application for 2 years)?

Please could you advice.

were you successful in your ILR aplication in 2014 with the gap of 1 month in visa extension.
