ILR short by Apx 21 days under Tier 1 General

ILR short by Apx 21 days under Tier 1 General

Dear All,

My visa issue date was 25th Jan 2009 but I arrived UK on 02nd May 2009, so I have landed after 90 days of visa issue. I have to calculate my 5 year from the arrival date, so my ILR is due on 02nd May 2014. According to my understanding, the earliest I can apply on 04th Apr 2014 but my visa will expire on 13th Mar 2014. Please suggest that shall I go for another extension or I apply for ILR by post? Can I take the chance at PEO for ILR?

Apply for an extension by post before leave expires then vary to SET(O) on 04-April-2014.

Txs of the reply, what about the feee? I believe that HO will deduct the fee for extension, so can I switch the same fee if I vary the application? Secondly if they are very quick and take decision on my extension before varying the application, can I still vary or I have to apply for ILR?

You should only pay the difference if any for a variation. It's unlikely a decision would be made in 3 weeks, though, if it was, you'd have to apply for ILR separately not as a variation.

may I add a little twist to the original question? what if late entry is less than 90 days? My wife's visa was granted on 5th of Feb 2009 ( 05-02-2009) but she came to UK on 26th of march 2009 ( 26-03-2009) nearly 45 days late so he ILR clock started to tick from this day. She got her first extension on time but now her visa is expiring on 23 of Feb 2014 (23-02-2014) nearly 30 days short of her eligibility for ILR, which is on 26th of March 2014 (26-03-2014) ( 5 years after she first landed in UK). So even for this 1 month gap ( 30 days ), will there still be requirement to apply for second extension?? shelling out 1000 odd pounds ?

If initial entry was less than 90 days, then her qualifying period started on the date on which the entry clearance was issued. She may apply for ILR within 28 days prior to the completion of her qualifying period and before her leave expires.

my case is similar like u but my ilr is due on may 2015.what have u thought about your ilr?have u spoken to any solicitor for your case?what have they suggested you for your late arrival to the country. will it work for your ilr?please suggest me.
