Hi RK,

My case is a little similar to that of your wife`s.

When do u plan to apply ILR (either thru FLR(M) + SET(M) OR SET(M) directly) for your wife ?

Please post your result and experience once done

Dear Amber and All the Gurus,

Many thanks for all your help.

My wife got her FLR(m) yesterday at Croydon PEO , it was a good experience we went to PEO at 11:30 and by 1:30 we were out with the result.

She applied as a Dependant of 10 Year Long Residence

But my main worry is can she apply for her ILR with set(m) asap , I am planning next week to book an PEO appointment.
as she got her Dependant visa before 9-july-2012 , My understanding is she should be considered under old rule according to that she has already stayed in UK more than 2 years ( in her case 4 + years ) as my PBS dependant. and now she can apply for ILR with set(m).
I did raised the query with the case worker after we got her FLR yesterday. But she was very confused herself but what she replied that my wife has to wait 5 years for her ILR because I got my ILR based on 10 year long residence.

I am really confused ,PLEASE help me and through some light on this matter.

Can I apply for ILR with SET(m)??

my case is
I got my ILR (long residence) on sept-2013
My wife was my PBS(tier1 gen) since May-2009
on 8-Jan-2014 my wife got her FLR(m)

Hi RK,

My case was similar to that of yours.. My wife got ILR based on 10 years long residence in the 1st week of decemeber 2013. I came to UK in Sep-11 as PBS dependant and hence completed more than 2 years.

I applied for FLR(M) in croydon PEO and got it approved. Then I applied for ILR thru SET(M) in croydon PEO and got it approved as well.

In the FLR(M) letter of grant of visa, it must say clearly that ur wife is eligible to apply for ILR anytime once she completes 2 years (Including the time she was ur dependant and not necessarily 2 years after FLR(M) ).

First check what is mentioned in the letter (Grant of visa) because one of my friend`s wife whose case is similar to me was asked to wait for 5 years in her letter of grant of visa (which is a mistake from UKBA).

as you have suggested I have checked the letter issued with my wife's FLR(m) visa grant.
Its not very clear.

on the page 2of3 under WHEN AND HOW CAN I APPLY FOR INDEFINITE LEAVE TO REMAIN?

the wordings are as follows.

" In order to qualify for settlement you must have completed a period of 2 year in the United Kingdom as the spouse. Furthermore since 2 April 2007 applicants for settlement have been required to show they have sufficient knowledge of language and life in the UK in order to qualify. You may apply for indefinite leave to remain in the United Kingdom once you have either passed the "Life in the UK" test or have improved by one level by gaining an approved English for Speakers of Other Language (ESOL) qualification which includes citizenship material. You must apply before the end of your authorised stay in the United Kingdom.

Could you please check does your letter had the same wordings.

Hi RK,

Unfortunately by mistake UKBA had retained my FLR(M) grant letter (I had it as part of the documents attached). I did not bother to ask them after I realised coz I already have ILR. But I am sure that the wordings were the same in my letter as well.

I am 100% sure your wife is eligible to apply for ILR where it clearly states in her FLR grant letter that she is eligible to apply for ILR once she completes 2 years as spouse. And as u said that she was on dependants visa as ur spouse since `09, she cud hav her ILR.

I would suggest that if you are not in a hurry wait till she receives her BRP as FLR and then apply for ILR as u have to submit ur FLR BRP as part of her application.

I am sure u r aware of the English language test, Life in the UK test and the cohab docs are all essential for her ILR.

Lemme know if u want to hire a solicitor and I can PM u the solicitor who got it done for me.

We have received her BRP today.
I will be booking her PEO appointment next week.

I will be submitting the same doc which I have used for her FLR(m)

PLEASE suggest are they sufficient in your opinion. or do I have to add any other documents ?

1) 6 months Bank Statement (Both)
2) Employer letter stating our Salary(Both)
3) 6 months Pay Slips(Both)
4) Address proof for 2 years ( Both)
5) Tenancy Agreement
6) Her English Test Certificate and Life in UK Pass Result
7) Marriage Certificate

Did you write a cover letter with your set(m) application??

That shud b perfectly fine infact more than enuf.. I am assuming that u have different sources of documents for ur cohab documents (2 years address proof)..

Another thing to note is that FLR(M) required a lower level of english while ILR requires B1 level. I did B1 and submitted it for both FLR and ILR. Hope ur wife got it that way.

for conab(address proof) I have

for my wife 6 doc from 4 different sources (over the period of 2 years)
for myself 6 doc from 6 sources (over the period of 2 years)
Hope that is sufficient?

for English B1 level for my wife.

Do i need English Language Qualification if i am Switching Tier (PSW) Dependent to FLR (M) as my husband is applying for ILR (LT) next month and when should i apply as my visa is expiring in July 2014.

I was told by my solicitor that an english lang test is not required if we did grad or post grad in english. I did my grad in India (although in English) but still did not want to take risk and hence gave the B1 level (which is sufficient for ILR as well) english test.
