Hello,

I am new on this forum. I don't know what to do so I hope you can please help me. I am Angolan with British citizenship. I have 2 children with my ex girlfriend one 8 and one 10 years. We are not together anymore. I went back to Angela after we split up but now I came back in November to the UK to care for my sick ex girlfriend and my children. My ex girlfriend had cancer and she past away 1 month ago in hospital by my side. . My ex girlfriend had ILR last year but did not apply for passport yet.

I am so desperate and don't know what to do for my children. I decided to stay in UK now for my children and get a job. I now live by my sister in London. I really want to help my children. How can I apply for passport for them?

I hope with all my heart you can help me. Thank you so much.

Were the children born in the UK?
Did they also have ILR? Or what is their immigration status?
On what basis did you qualify for British Citizenship?

Thank you so much CR001! Yes the children were born in UK in London but they don't have passport and no ILR. Only their mom had ILR.
I came to UK in late 90's to work and got a visa. In 2002 I got a sollicitor who helped me to apply for ILR. I now have ILR. Can I help my children?

If they were born in the UK, apply on MN1 under section 1(3) to register them as citizens. Once you receive their certificate, apply for passport.

That is so good to hear! I will fill in the form today. Dear CR001 would you know how long Home Office might take with the certificate? Do they have long waiting times?

MN1 applications take a couple of weeks to a couple of months, depends how busy UKBA are. You will receive their certificates in the post and once you have that, you can apply for their passports.

Were you British at the time of their birth??

Yes it does as they might be able to apply directly for British passports and you would not need to register them on MN1 first.

Were your children born before July 2006?

Were you married to their mother at the time of their birth?

Being born in the UK doesn’t automatically give you British citizenship.
If you were born on or after 1 January 1983, you will be a British citizen if your mother or father was either:
a British citizen when you were born

In most cases you will be a British citizen if your mother or father was born or naturalised in the UK.
If you were born before July 2006, your father’s British nationality will pass to you only if he was married to your mother at any time.

Yes my children were born before July 2006. One girl is now 10 and my other girl is 8 and was born in October 2005.

I was never married with their mother. She got her ILR in 2012. I got my ILR in 2001. So I had ILR when my children were born.

Can I in this case apply for their passports?

I am not 100% sure in this case as you were not married to their mother. Do you feature on the birth certificates as the father?

I think in all probability, you will need to apply for MN1 and then for their passports once you receive the certificate.

It is unfortunate that you were not married at the time of their birth.

My daughters MN1 registration took 5 weeks, so it is generally quite quick if all your docs are in order and you have the money to pay.

To register as British on MN1 it is £673 per child if applying at different times or if applying for two children together (separate forms though) it is a joint fee of £1178. Fees go up on 6th April each year.

Passport applications are an additional £46 each.

It does say that one is automatically a British Citizen if "one of your parents":
-If you were born in the UK on or after 1 January 1983, you are a British citizen if at the time of your birth one of your parents was:
a) a British citizen; or
b) legally settled in the UK

I would advise you to call UKBA and ask, tell them that you were never married but that your name is on the child's birth certificate. You might save on registration fees

From the same link you have provided abc_uk, the definition is :
Parent

A parent is the biological mother of a child, the biological father if he was married to the mother when the child was born or if he can prove paternity, or the adoptive mother or father of a child who has been legally adopted. For children born before 1 July 2006 citizenship could not be passed on from a father if he was not married to the child’s mother.
The OP and the children's mother were not married at the time of their birth.

cr001 thank you for clarifying with regards to the marriage. I will fill in 2 forms for both of my children and send the forms in at the same time. Do i put in cash money for £1178 in the envelope together with the forms?

You can pay by cheque or postal order or you can fill in the payment slip (link below) to pay with a debit or credit card. Write both childrens names on the payment slip.

All the best and keep us updated on your progress. Another point, you might need to include their mothers' death certificate etc.

Also, consider using NCS at your local council to submit the applications for a small additional fee. They will take copies of everything and return all originals to you.
