hi,

i have been referring to this forum from last 2-3 years and can tell that this forum seriously saves your money , instead of going to the solicitor ,i have got my ilr (tier1)(g) due in march with 1 dependent and got few questions

tier 1 granted from india - 16apr2009 valid till 16apr2012
first entered uk - 12july2009 (within 90 days)
depenedent visa granted from india -11aug2011 valid till 16apr2012
dependent first entered uk - 01sep2011
extension application posted 03apr2012
tier 1(g) extension valid till 18jun2014 ........same for the dependent

as per my understanding i am eligible for ilr after 18mar2014 ,i am going for same day service,suppose i go on 20mar2014 for the appointment so my absence from the uk will be calculated as follows


absence (considering only the whole days outside uk)

20mar2014-19mar2013 ------ 27 days
20mar2013-19mar2012 ------ 0 days
20mar2012-19mar2011 ------- 31 days
20mar2011-19mar2010 -------- 28 days
20mar2010-19mar2009 -------- 0 days (considering u dont take the days b/w entry clearence stamp and the date u first entered uk as abesence)

me n my wife both got the degrees from india and its granting the 10 points for english requirement.

i am taking following docs with me.

1. 4 p60's
2. 12 months payslips
3. 12 months bank statement showing salary paidin
4. life in uk certificate (both me & wife)
5. home office letters for tier1 extension approval (both)
6. marriage certificate
7. degrees n transcript (both)
8. filled forms
9. 3 months bank statement for maintainance (additional i think u dont need)
10. passports & brp;s (for both)
11. pbs calculaor printout for both for english requirement.
12. letter from employer confirming continous and permanent employment since jun2010
13. cohibition docs got loads ,but lives in a friends flat so dont pay the bills
14. photocopies of all the docs.including the stamped pages on the ppt.
15. absence template (pls is somebody can provide)
16. cover letter

got few questions for moderators sorry if already been answered........

1) i was doing some self employment during short period but i am not claiming any points on that earnings do i still need to mention it, and provide any documents.

2) do i need a letter from the employer regarding the absence as i was all paid leave, if i want i can get it

3) how many cohibition docs shud i attach, i think its 3 docs from diff sources addressed separately at same address in the interval of 3months...correct me if i am wrong

1. No need to mention earning from self employment.

2. Not necessary if absences less than 180 days however if you can easily get the letters please do so

3. Yes you are right

4. Not sure

5. No need but you can use them as additional documents

6. I think your docs pretty much covered everything ho needed.

4. Cannot start from 19 March 2009 as Tier 1 was valid from 16 April 2009. Your years should be calculated from 16 April.

If you can get the letter, that will be great, otherwise absences of less than 180 days do not have to be explained.

Cohabitation documents can be letters jointly addressed to you both, or addressed to each one of you at the same address, e.g. documents showing joint commitments such as bank accounts, investments, rent agreements or mortgages; or letters linking you to the same address; or official records of your address such as your National Insurance card or health card.

3)when we say 3docs each addressed individually in 4months is that can b 1 in each month like jan,feb,mar or has to be all 3 from same month

4)is there any issue if my wife letters are from jan,feb,mar in 1st quarter & mine is 1 from feb,2 from april or any other combination of months?

5) I entered uk on 12jul2009 so if I go for same day service on 20th march it will be 4yrs 8months 8days in uk so shud I write 4yrs 8months or 4yrs 9months in question how long u lived in uk?

at least 28 days before current leave expires therefore if 18 March makes 28 days then yes, that's correct.

There is no defined number and it is entirely up to you what you provide. Just make sure, though that your documents are spread across the last two years in terms of their dates.

1) my first entry clearance if from 16apr2009 but I entered first uk on 12jul2009 within 90days ............and my current leave expires 18jun2014 cos they took 3 months in tier1(g)extension giving me approx. 2 months extra leave but I think I am eligible for ilr 18mar2014 counting from entry clearance stamp 16apr2009 as I entered uk within 90days ....so I can apply before the fee hike in april 2014 and don't have do wait for 28days before my current leave expires......can u pls confirm?

2)11l says "Tier 1 (General) migrant If you are applying for indefinite leave to remain on completing 5 years’ continuous
stay in the UK made up of leave as a Tier 1 (General) migrant and leave as a highly skilled migrant, work permit
holder, innovator, self-employed lawyer or writer, composer or artist, in addition to the relevant documents in
11A, you must provide the following documents" .....I understand its for ppl who got combination of tier1 and any other category....but I have been only on tier1(g) since starting....so cant see any 11(b),(c),(d)...or any other apply for tier1(g)........................pls correct me if I am wrong?

Please ignore my point above about ticking 11L. I've copied and pasted the relevant instruction from a question and answer link on this forum below for your understanding, therefore disregard what I said.

Q35 - I am a Tier 1 (General) migrant. How can I satisfy the following instruction in section 11L of the SET(O) form - "For the period before you were granted leave as a Tier 1 (General) migrant, documents showing that you met the relevant requirements of the immigration rules."?
1. If your (5 year) qualifying residential period preceding settlement application does not include a period of stay in the UK as a WP migrant, Tier 2 migrant, innovator, self-employed lawyer or as a Writer, Composer or Artist, and you never entered UK before being granted leave in any of these categories then this instruction does not apply to you.
2. If your (5 year) qualifying residential period preceding settlement application includes a period of stay in the UK as a WP migrant, Tier 2 migrant, then this instruction applies to you and the documentary evidences required will depend on which leave you were under (e.g. - WP authorisation, Letter from then employer confirming employment, salary slips, P60, evidence of self-employment, etc.).
3. If, during these 5 years, you were in the UK in any other immigration category (other than Tier 1 (General) and other than any of the categories mentioned in 1. above) and switched to Tier 1 (General) this instruction may apply to you and the documentary evidences required will depend on which leave you were under.

1) shud I tick the (b) or not as me & wife both attaching dergree taught in English with pbs calculator printout.

2) I am claiming the earnings from march 2013 to feb 14 so attaching the payslips and bank statements to show salary, one of the bank statement of june 13 was missing so I got a printout of the bank statement on the letter head of the bank stamped by the bank on 15aug.........is it fine or has to be the latest stamp within 1 months before application.
