Hearing on 23rd January, Documents and Bundle

Dear All,

As many of you know I have hearing on 23rd January 2014 and finally all the paperwork is ready and its time to submit the bundle but before I do that I would like to share the list of docs I am submitting with the bundle and any comments or suggestions will be highly appreciated.

1. Business Plan (which was not submitted with initial application but did produces in interview but didn't submit)

2. Joint UK Bank account statement confirming access to 50K. (from application submission
till dated)

3. Personal Account statement. (Showing funds was transferred from my personal account to Joint account over the period of 3 days and also showing the source of funds as monies was transferred by my father into my personal account and my team member also transferred funds into my account but later we manage to open joint account and I transferred all funds into joint account for both of us having equal access to funds)

4.Business Bank account statement from the date of submission of application till dated. (confirming all the payments made by the clients as per all the invoices)

5. All Advertisement Printout. (Also submitted in interview and initial application)

6.Updated Website Printout (also submitted in interview and initial application)

7.Leaflet printout. (submitted at interview)

8. Professional indemnity Insurance certificate. (never submitted before neither in interview or initial application)

9. All the invoiced issued to clients since started trading. (Submitted Contract with initial application and Submitted upto date invoices in interview but again resubmitting it all again from the date of trading and its around 30 Invoices with different clients)

10. Previous work experience letter. (Never submitted before as it wasn't required but they did mention in refusal letter so submitting now)

11. Current appointment report fresh copy confirming we both are still director of business. (did submit 1 with initial application and another one at interview)

12. A solid statement prepared by my solicitor which is around 10 pages. (never had good experience with solicitor ever but must say he did impress me with the statement)

13. Annual Return Submission confirmation email and payment receipt.

that's about it ..... I am not submitting any accountant letter or anything like that at all as I have not submitted any tax return yet as its not due yet .... but Annual return is submitted online by myself.

any comments or suggestion will be highly appreciated and if someone don't know why my application was refused so here the link to the post where you can find all the information in regards to the full refusal points ....

Hi rehan I will suggest you to concentrate only on the refusal points don't make it complicated by attaching such documents where they did not asked for it. For safe side take them with you if they ask you then provide them. Otherwise keep them with you. Trust me they will only argue about your refusal reasons nothing else than that.

Thanks sad.1 appreciate tht ..... Besically if u have a luk at my refusal reason link provided in my post u will knw i need all these docs as thy question credibility n viability of business not genuine entreprenuer, were funds comes frm, previous experience letter not provided and surprisingly why i choose to advertise my business online...

Nice home work you have done. I rather you submit all prepared document to avoid loopholes. Have you not done your annual returns yet? If you have include the paper work also from company house. I wish you well and victory to all fellows in the struggle.

@ Rehan, its better to be prepared for all possible questions from HOPO because you never can tell if they will conduct another interview again during your appeal hearing as some members have stated in their post. But make your refusal points to be the major focus during your submission at the hearing and only discuss other points after you have trash their silly refusal points if you have enough time.

All your refusal points are based on entrepreneurial test and you should be able to win the appeal if you can convince the judge that you are trading with regular income into the business account.

I will again advice that you should have plan for your ILR application since you stated that you have clocked 10yrs already so that you can submit it immediately after the appeal if its not favourable but hopefully you will win your appeal.

if i were you, i wont mind to withdraw my appeal before the hearing date and submit ILR application on the same day of appeal withdrawal because the appeal delay is just crazy and uncertain. The reason why i said this is because you will eventually have to submit the ILR application and for me i will have just love to get it out of the way and forget their useless appeal headache.

many thanks for your comments as always very detailed and helpful reply, highly appreciated.

Yes totally agree that attending hearing can be another interview to attend or can be very simple and straight forward as its all individuals luck but its better to be well prepared for everything.

Ever since I started this business I am successfully trading and business is also doing well and have all the relevant docs to prove that too e.g (business bank statements, Invoice issued to client for services provided etc)

Also I have not touched the money in business account which I received from the clients as I don't want them to get an impression that money is been relocated in my account so all the money I received is sitting in business account and I only made few payments via debit card for the things I bought for business.

in regards to my ILR I have it all ready and the day I will get the Tier 1 visa I will submit the ILR application next day and the reason I didn't withdraw my appeal was that I applied as team and my team member is my younger brother and I don't want to take any step which will cause trouble in his application plus we are doing business together and we will be in future too but I can understand your point but I have no choice apart from winning this appeal.

Yes Annual return is done and I have taken the printout of the confirmation email I received from Companies House and the payment receipt as well ...... I have also made the payment from my business account so it shows transaction there too that I paid the money to companies house and thanks for your comments and advice.

Dears Friends.
I have submitted my appeal on 10th of Dec 2013 and my court fee has been deducted but I did not received any hearing date..... do you know when my hearing date will be allowed..........Any idea about expected court hearing date......

hi kindheart,

its better if you start your own thread as you r most likely to view of other users .... anyway after fees deduction you should get hearing date allocated with in next 4 to 8 weeks but no one can tell you that when it will be for.

so just wait and you should hear from them soon or try calling tribunal after 3 weeks of fees deduction and they should be able to update you.

Better that you have done your home work.Judge will only want to discuss the refusal points but I have seen HOPO try to find out other things from the applications and can ask irrelevant questions.
Payments from business account for business expenses are all related to business so I don't think that is an issue.

Judge didn't ask me any question what so ever apart from standard question that I have signed the statement and its all true and HO barrister bombarded me with question and most of the discussion was regarding the investment funds, where they come from etc and regarding services we have provided and what invoices issued to clients.

I have posted a details in the hearing attended post please have a look and you will have good idea of my hearing and my suggestion is to be very well prepared for everything ... .business plan, funds etc
