EEA4 as a dual citizen

Post by maviesk » Fri Feb 28, 2014 12:13 am

Hi there,

I've read so many threads on the subject, some of them from a couple of years back and I wanted to get an up to date and concise answer if possible.

I'm an Irish/British dual citizen and my partner is Turkish. We applied for the 5 year residency back in 2010 when it seemed less of an issue to be a dual citizen (he entered to the UK in February that year). Since then, I see there has been the McCarthy case and the regulations have been tightened.

Today I was looking at threads and the EEA4 form and I noticed there is a question asking whether the EEA family member (i.e. myself) is also a British citizen? Are we now going to run into problems when we apply for PR next year?

Thanks in advance for any answers.
David

No issue in your case as you were under the old rules. You will need to provide evidence you have exercised treaty rights in the UK for 5 years.
