Help! Is No Further Action equal to Pending prosecution

Post by deepblue » Thu Feb 27, 2014 8:48 pm

I made the cardinal sin of following the law and reporting a road traffic incident to the police. I suspected a very small minor collision which another car which did not stop. I proceeded to report it to the police. a month later, I got a No Further Action letter from the local police. I am now worried that the police actually have got me down as a potential suspect by advising they will not be prosecuting me for now but if new evidence comes to light may do so in future. WHAT THE F**K! I was the wronged party here and reported it in the first place! This was more than 2 years ago. Does this mean I have a pending prosecution? Do I have to declare this on my naturalisation form? HELP PLEASE I AM PANICKING! Should I be worried?

It just means that the police are not going to pursue the matter either way unless more evidence comes to light. Considering it's been two years, I doubt it will. It is just a letter informing you that the police are parking (excuse the pun) the investigation, but reserve the right to resume the investigation if needed. It's quite common.

Based on your post, you do not need to declare this as you were not charged nor convicted with an offence.

Deep Blue relax. No further action means just that. HO isn't obsess with would-be or might-be or could-be events. It's simple do you have a conviction or not>? Based on what you shared the answer is NO. Apply with confidence all the best.
