Hello everyone, I need you guys help here . I came to the UK in 2014 and overstayed my visa. Got married to EU partner in July 2019. Pre-settlement status issued on November 2020. We recently got divorced on April 2024. I want to ask if I apply in July which is 5 years of marriage do I qualify for settled status or I have to apply for retain right (pre settlement) and wait till 2025 to apply for settled status. Please advice. Thank you.

Applying is free, worst that happens you apply for settled status and you are told to wait until November 2025.

Thank you for your reply. Are the following documents good to upload;
1. Marriage certificate
2. Final order(divorce)
3. 4 years council tax
4. 3 years joint bank statement
5. 4 years tenancy agreement
6. 4 years utility bills(water)
7. Copy of my ex wife ID
8. Employment letter and payslips (myself)

I am not sure about this. Hopefully someone else with more experience of the process can comment, but I imagine you need to show evidence of the relationship and take steps to inform UKVI of the end of your marriage.
