Previous earnings - Help me to decide please

Post by jd » Fri Jun 29, 2007 4:42 pm

Hi buddies,

I'm going to apply in August. Although it is bit earlier but I want to take a decision so I can schedule my other things.

Please have a look at following my earnings which I want to show to case worker and claim points.

My question is just simple but I want to discuss with you guys. With Apr-07 salary I got bonus [24138] (this is mentioned on my salary slip as bonus). Will case worker consider this as my earnings or not (as according to guidance notes bonus will be considered as it is mentioned on salary slip)? Please advise me on this as if this'll not be considered then I simply loose points and not able to claim 75 points.

I'll have to wait another 2-3 months if this is not considered.

is it critical to include the bonus to get the points you want?

I was approved and I used a period with 2 bonuses in the period claimed. Without them, I would not have had enough points.

Can you also obtain a letter from your employer? My wage slips showed quite clearly what the extra money in those two paychecks was, but I also included a letter from my employer. Among other things, it included this sentence:

"Ms. So and So’s annual bonus for 2006 (included in the March 17, 2006 paycheck) was $XXXX.XX USD and her 2007 bonus was $XXXX.XX USD (included in the March 2, 2007 paycheck)."

I don't know that the letter was needed, but I doubt it hurt. But yes, per the guidance notes, bonuses are allowed...but it strikes me as an area that can be easily confused, so it would behoove you to make things as clear as possible for the caseworker.

SYH, apeterso925 thanks for your comments.

SYH: yes it is critical to claim bonus points because without including bonus I won't be able to make enough points.

apeterso925: my employer agreed to give me a letter stating my total salary in past 12 months. I'm thinking to ask them to include two more sentences that i've been paid a bonus with Apr 2007 salary. I think that would do? what u think?

Also, can you guys suggest me re earning evidences:

i'm providing following:
1. salary slips
2. bank statement
3. letter from employer stating total salary (now i'll ask them to mention bonus)
4. a letter from employer detailing breakdown of income tax which they submitted on my behalf. (I'm gonna apply start of August and at that time i won't have income tax return. I'll get ITR by end of September)
5. ITR of previous financial year.
6. National tax certificate.

I'll b very much thankful.

Thanks,
JD

Yes, I think you need to include a sentence that specifically discusses the bonus amount. That way, it's as clear as possible.

Your documents look good, I don't think I can speak well to the tax necessities, as each country's tax issues are different.

My tax document did not match my wage slips because of the way the US tax system is structured. I did not include an explanation for this, but I had 2 other pieces of evidence that corroborated my wage slips, even though my tax document did not.

I also included an exhaustive list of ways that the HO could contact my employer to verify the information. I know they didn't call because we're a small office and the payroll lady told me they never called, but I can't help but think that my obvious total willingness for them to double check my claims made my application more believeable.

It seems like they are looking for 2 reasons under past earnings that your wages are less than you say: 1) you just didn't make enough and you misunderstood the guidelines or 2) you're deliberately trying to show more than you earned.

So I tried to show that 1) I had read the guidance notes and knew that my bonuses were allowed and 2) that I was being truthful in my claims and had nothing to hide, should the caseworker call my employer.

But lastly, *if* the caseworker had called my employer and said he was concerned because according to the tax document, I only made $XXXXX, but my wage slips had higher amounts, my employer would have explained why.

So all in all, I think the more info you provide, the better.
