Private life UK visa query.

Hi All,

I would like to inquire about the eligibility for a UK Private Life Visa, also known as a Family Visa, for my child. My child, who is over seven years old and Indian-born, has resided continuously in the UK since March 2018.

My current three-year Skilled Worker Visa is set to expire on January 29, 2025. While I require a two-year extension for this visa, I have also previously held an ICT visa for four years and ten months. Given the current challenges in obtaining a Skilled Worker Visa and potential redundancy changes within my organization, I am exploring alternative options.

Could you please confirm if my child would be eligible for a Private Life Visa, which would provide a two-year and six-month extension and subsequently qualify me for the 10-year Indefinite Leave to Remain (ILR) route?

It would be unlikely for you to apply and get visa under the private life route.
It is a common error to think having a child living here for 7 years magically leads to a private life visa. There is no automatic 7-year path to ILR for children, either. Children of migrant workers will follow the same path as their parents. Also, it is reasonable to expect them to accompany their parents and leave the UK, if the parents cannot normally stay in the UK.
Residence requirements for a child on the Private Life route
PL 3.1. Where the applicant is aged under 18 at the date of application the following requirements must be met:
(a) the applicant must have been continuously resident in the UK for at least 7 years; and
(b) the decision maker must be satisfied that it would not be reasonable to expect the applicant to leave the UK.
