Problem with Employer

Hi,

I came to UK through an Indian Company XYZ to work on a project (on WP).
I got my own HSMP and have searched a job. My notice period for resigning in India was period of 3 months.

I would like to know the rules of UK, what is the minimum period of notice an employer can demand. (I need to join another job, but my employee is emposing 3 months as per Indian rules) . I hope Indian rules are not applicable in UK.

Please guide.

What does your statement of employment say? You do have that document, don't you? After all it is a legal requirement for he employer to issue it within 8 weeks of the commencement of the employment.

Hi John,

I have not been provided any 'statement of employment ' for UK.
When my employment started in UK, I was given a deputation letter, which doesnot talk on this aspect. it does mention that the Working hours, holidays and leaves are as per UK policy.

My Indian letter of employment states that I give 3 months of notice when in India.

Normally when an Indian company brings its employee in UK they donot prefer that the employee leves the organisation. They try there best.

If there is no notice period in that document then look at this webpage where you will see that you need to give a least one week's notice. That is the law, but usually the period is varied in the Statement I mentioned earlier.

In my experience notice periods are unenforceable, who wants a pissed-off employee wreaking havoc to force a principle?

The only issue is pay, they might pursue for that but chances are you'd have worked a month in hand anyway.

Oh, and the possibility of a bad reference!

If your employer didnt provide you ANY document about UK holidays ,Notice period etc, approch your local CAB....I know a friend from an Indian co. having gone through the same process...He approched CAB and got a favouble reply.
