psw uni letters enquiry

my psw visa application got refused on two grounds. (applied on 8th of march 2011)

1. college letter clarifying comlpletion of my degree was provided instead of the actual degree from the wales university. ( that is also why i did nt get 10 points for english)>> I NOW HAVE THE ORIGINAL LETTERS FROM UNIVERSITY!!

2. second reason why i got refused was because i did not maintain 800 pounds for three months. reason is following.

I. my visa was revoked. i appealed, HO asked for my passport to give my status back. i sent it on 6th of december 2010. My lawyer got the passport by the end of december ( probably because of christmas holidays). the issue date was 9th of december until 8th of march. ( 3months).

II. now the point is i was only left with 2 months to get my bank statement ready. i maintained it. but for the month of december i could not maintain it as i was not aware when i will get my passport. however, i had around 1100 in my account which i spend during the month( december), unaware.

i have appealed and my lawyer is pretty confident that we will get it. at the same time he is also saying we can even go to higher court if it got refused. I am confused because there was nothing i could do, so why are there chances of my appeal to be refused????

Plz guide me with your wisest suggestion. Really appreciate your time!!!!!

If you knew how long you had asked the visa for then you would know how long it would be valid for even if your passport was not with you.

You could have still maintained 800 in the bank before you even got your passport as you had intention of applying PSW. But as your case is a bit different it might be arguable in the court.

On the Appeal day:
1. You would have your solicitor and you
2. A representative from HO (If he is present, the appeal can be more difficult to be successful as he will appose to your solicitor claims)

sometimes the representative is not there for operational reasons.

3. The Judge himself.

When your turn comes up, your solicitor will give the grounds of appeal and if there is any question he would ask you and any argument from the HO representative.

IF the judge thinks its str8 forward he will give you decision same day or reserve it and your solicitor will get it probably in 1-2weeks or more.

HOME OFFICE will have 5 days to appeal against the deicison made by the JUDGE to the HIGH COURT if they do not. Your visa will be issued

on the other had if you loose your appeal, you will have 5 days to appeal to HIGH COURT.

hope all is clear. Solicitors usually charge you high price with confidence but as far as my experience if you did not maintain 800 your visa chances are bleak
