Hi I am a Pakistani national and non-EEA family member of EEA national who has been exercising her a Treaty Rights in the UK since 2010. My question is about retain of rights after divorce. My detail is as under:-
I came to the UK as student in April 2006. My 10 years legal stay will be completed in April 2016.
We married in London in August 2011( three years have been completed). We have no children.
I got Residence Card in February 2012 for five years till February 2017.
We are still living together. My wife is self-employed and also work part-time.
I'm working part-time and studying in university at degree level and paying my tuition fee through student loan from Student Finance England.
My wife is Dutch national. She wants to move to Netherlands in October 2014 and wants to apply divorce there. She wants to help me if I need any documents but she doesn't like to live here any more and wants divorce.
Can I retain of my rights after divorce or get ILR after 10 years stay in April 2016?
What documents do I need from my wife for retain of rights?
